The Holy Qur'an is very cautious in matters of divorce. Three talaqs have to be spaced over a period of 3 months to give husband and wife time for reconciliation through the intervention of relatives and friends. Moreover, talaq can be pronounced only when the wife is in a state of tuhur, ie purity after menstruation. Yet, despite clear Qur'anic injunctions to the contrary, immediate triple divorce is permitted, destroying marital life in one breath. The practice of immediate triple divorce is widespread among Sunni Muslims and has legal validity. Even then the jurists call it a talaq-e-Bidat (innovative form of divorce). The dispute has been highlighted by reports of some Muslims instantly divorcing their wives by mail, over the telephone, and even through mobile phone text messages. This article explains the different theories of divorce prevailing in the contemporary Muslim world and what checks and restraints have been imposed by Islam over the exercise of husband's power of talaq. The article critically appraises the lsquo;innovative triple divorce' by examining whether it is sanctioned by the Holy Quran or the sunnah and if there is a consensus of opinion (ijma) on the effectiveness of triple divorce.

The most common way North American Muslims relate to shari'a is in their observance of Muslim marriage and divorce rituals; recourse to traditional Islamic marriage and, to a lesser extent, divorce is widespread. Julie Macfarlane has conducted hundreds of interviews with Muslim couples, as well as with religious and community leaders and family conflict professionals. Her book describes how Muslim marriage and divorce processes are used in North America, and what they mean to those who embrace them as a part of their religious and cultural identity. The picture that emerges is of an idiosyncratic private ordering system that reflects a wide range of attitudes towards contemporary family values and changes in gender roles. Some women describe pervasive assumptions about restrictions on their role in the family system, as well as pressure to accept these values and to stay married. Others of both genders describe the gradual modernization of Islamic family traditions - and the subsequent emergence of a Western shari'a--but a continuing commitment to the rituals of Muslim marriage and divorce in their private lives. One focuses on the procedure laid down for giving the seal of final authority to a divorce. The other explores the processes that are set in motion once the stability of a marriage is threatened. The latter perspective does not see divorce in isolation but treats it in the wider context of social structure. When divorce in Muslim communities is discussed, the tendency quite often is to place theology and law at the centre. This book recognizes that divorce in Muslim communities entails substantial theological and legal dimensions, but takes as its point of departure the view that it is only by placing divorce in the social and cultural context that meaningful conclusions can be arrived at. It examines, in the light of empirical evidence, the incidence of divorce and separation, the social and other causes due to which divorce and separation takes place, and the position of divorced women in society as well as their prospects of remarriage. In the process substantial methodological and theoretical questions relevant to the study of divorce as a social phenomenon are raised. The book has an immediate practical aim as well. Muslim law of divorce, particularly the provision of triple divorce, which vests a unilateral right in the husband to pronounce a summary divorce upon his wife, has been the subject of considerable controversy. Essentially, the papers brought together in this book are sociological analyses of divorce and remarriage among Muslims in India and the data thrown up as part of these analyses should clear some points in the controversy.
