Common structures of a national state were not visible in the African country. Somalia, even though far from politically stable under the dictator Siad Barre, had been suffering even more after the down-fall of the regime in 1991. Ever since, war, destruction, hunger and poverty had been predominant in the fragile state. It lacked organisation, authority and essential structures. Terrorist groups as well as warlords shaped the political landscape of the country. And although Somalia had transitional administrations from 2004, it did not have a functioning central government until the 2012 election of President Hassan Sheikh Mohamud. Shortland and Percy described the situation accurately by stating: “anarchy on land means piracy at sea”.

They have mounted what amounts to the most substantial non-state threat to the security of international shipping for half a century and perhaps longer. Piracy outbreaks have also occurred in Southeast Asia and West Africa. In each case the international community has responded differently. What lessons can be learned from three different approaches and is it possible to distill lessons of international best practice that can be applied in the Gulf of Aden and the northern Arabian Sea? This paper will examine how and why these three piracy outbreaks arose. It will describe in particular why the threat off Somalia grew so rapidly, why it declined and why the elements that made it successful remain in place. It will examine the responses of the international community, asking whether or not the response off Somalia might have been more effective if it had benefitted from stronger international backing and more coherent coordination. It will make the point that maritime security – the prevention and suppression of disorder at sea – must address many more issues than piracy as the theft of fish and the movement of drugs; weapons and people can often present greater risks. It will build on this point by looking at maritime security developments drawn from all three regions that may be employed advantageously in the Gulf of Aden and Arabian Sea, before circling back to look at the fundamental problem, which is one of landward security and asking what initiatives have been taken to address this in Somalia and which ones appear to be yielding results. Finally, it will examine whether the way forward does lie with a unified global initiative, or if steps are better taken regionally calling upon extra-regional support as necessary.

Given the scarcity of regional capabilities to police these waters, Coalition naval forces maintain a maritime security presence in the region. These forces have had some notable successes, but face a complex challenge in suppressing piracy and human smuggling. At the heart of this maritime problem is the vast and ungoverned land area of Somalia, in which chaos creates too many incentives and not enough deterrence for maritime criminal activity. The recent creation of a United States Africa Command (USAFRICOM) places the landmass of Africa (except Egypt) inside the AFRICOM AOR. As a result, the dynamic waters surrounding the Horn of Africa will soon lay on a seam between the USCENTCOM AOR and USAFRICOM AOR, creating new challenges and opportunities for conducting maritime security operations in the region. This paper will first discuss the operational factors that affect maritime security efforts to date. It will then examine command and control implications brought about by the creation of USAFRICOM and the combatant commanders shifting seams of responsibility. Finally, it will make recommendations on how to work effectively across this dynamic seam of responsibility to the benefit of both USAFRICOM and USCENTCOM.

As Somalia is unable to repress piracy, the U.S. National Security Council (NSC) developed the interagency Countering Piracy off the Horn of Africa: Partnership and Action Plan in December 2008 to prevent, disrupt, and prosecute piracy in collaboration with international and industry partners. In September 2010, GAO issued a report evaluating the extent to which U.S. agencies (1) have implemented the plan, and the challenges they face, and (2) have collaborated with partners. This testimony is based on the September 2010 report and its objectives, and work GAO conducted in March 2011 to update report findings. GAO is not making new recommendations in this statement.
