Unfortunately, international conventions and domestic laws intended to control marine debris have not been successful, in part because the laws, as written, provide little incentive to change behavior. This book identifies ways to reduce waste, improve waste disposal at ports, and strengthen the regulatory framework toward a goal of zero waste discharge into the marine environment. Progress will depend on a commitment to sustained funding and appropriate institutional support. The Interagency Marine Debris Coordinating Committee should, through planning and prioritization, target research to understand the sources, fates, and impacts of marine debris. It should support the establishment of scalable and statistically rigorous protocols that allow monitoring at a variety of temporal and spatial scales. These protocols should contain evaluative metrics that allow assessment of progress in marine debris mitigation. Book excerpt: In recent years there has been an increased realization that the casual disposal of wastes can lead to a deterioration in environmen tal quality with substantial impacts on society. The management of waste disposal practices must consider the various alternatives of discharging and decomposing wastes on land, in the atmosphere, and in the marine environment. Up until 1972 ocean dumping was used increasingly to dispose of sewage sludge, industrial wastes, and dredged material. In subsequent years regulations were developed to reduce and minimize ocean dumping. These regulations were prompted often by ignorance of the possible effects of waste disposal in the ocean rather than by knowledge that such ocean dumping was detrimen tal to the marine environment or to man. The relationship between waste disposal and the oceans can be viewed in either of two ways. One may want to assure that waste disposal procedures do not alter adversely the marine environment, or one may choose to utilize the ocean as a waste depository to reduce the burden placed on the con tinental ecosystem and on the atmosphere. From either perspective it is essential that there be an adequate base of technical information to assess the fate and effects of wastes introduced to the ocean. A series of original technical papers has been compiled in this book to present some of the recent results of research on industrial waste disposal in the ocean.

While technological developments have improved our lives, most of these compounds end up in our oceans where they threaten marine life and human health. The practice of ocean waste disposal has had a long history and was initially believed to have minimal associated costs. However, it is now clear that although we can use the oceans for cheap waste treatment, we do this at the expense of the other key benefits we derive from the sea, notably human food supplies as well as its aesthetic value (including opportunities for recreation and tourism). Many of the pollution problems of previous decades appear to have been solved in the developed world, or at least managed to minimise their environmental impacts. However, despite treatment being available for some waste products, a potent mixture of toxic compounds and other potentially harmful additions continue to enter the marine environment every day. So, have the problems of marine pollution really been solved or have we simply generated a suite of different and potentially more complex challenges? In this volume we consider marine pollution from the perspective of the historical problems that are now successfully managed or solved, the ongoing problems and the emerging challenges that we face. To face these challenges, this book claims that environmental law needs to shift attention from media-specific pollution regimes to integrative life-cycle approaches of waste management i.e., from the prevention of waste generation to the actual handling of wastes. Furthermore, the cooperation of States and the establishment of coordinated activities is essential because states can no longer have separate standards for wastes posing transboundary risks and for ‘purely domestic’ wastes. Drawing upon both International and EU law, the book provides a detailed analysis of the regimes set up to deal with the transboundary movement of wastes and ship-source pollution, so as to elucidate the obligations and legal principles governing such regimes. It concludes that treaty obligations concerning transboundary movements of wastes are inapplicable to ship wastes while on board ships and on land. However, despite the limitations of the transboundary movement of wastes regime, the principle of Environmentally Sound Management (ESM) embodied in this regime has gradually transformed into a legal principle. ESM works to address the legal gaps in the regulation of wastes, and consequently, it provides the desired coherence to the legal system since it acts as a bridge between several regulatory and sectoral levels. Furthermore, ESM offers a new light with which to understand and interpret existing obligations, and it provides a renewed impetus to regimes that directly and indirectly govern wastes. This impetus translates into greater coordination and the establishment of cross-sectional policies. By offering alternative ways to solve problems linked to the management of ship wastes in the sea-land interface, this book will appeal to anyone with an interest in International Environmental Law.

We also hope to increase the understanding and exchange of information from a global per spective. For the sake of younger workers, we hope that this exchange will prevent duplication of effort, the sad "reinvention of knowledge." An ulterior motive of ours is to create a living bibliography by not only having this document available as a printed text, but also as references with abstracts on word processor discs, so that researchers, teachers, and managers can update and expand this bibliography in their own fields of interest. We hope to be able to find a distributor for these discs in the near future. To establish greater communication we had hoped to have an appendix with author's names and addresses; however, we found that we had less than half of the senior authors' current addresses. Therefore, for subsequent editions, we hope our fellow scientists will keep us informed of their work and current addresses, and will bring to our attention any errors or papers that we have inadvertently missed. Our aim is to produce another edition in three years.
