Book Synopsis Cohabitation and Marriage in the Americas: Geo-historical Legacies and New Trends by : Albert Esteve
Download or read book Cohabitation and Marriage in the Americas: Geo-historical Legacies and New Trends written by Albert Esteve and published by Springer. This book was released on 2016-11-03 with total page 311 pages. Available in PDF, EPUB and Kindle. Book excerpt: This open access book presents an innovative study of the rise of unmarried cohabitation in the Americas, from Canada to Argentina. Using an extensive sample of individual census data for nearly all countries on the continent, it offers a cross-national, comparative view of this recent demographic trend and its impact on the family. The book offers a tour of the historical legacies and regional heterogeneity in unmarried cohabitation, covering: Canada, the United States, Mexico, Central America, Colombia, the Andean region, Brazil, and the Southern Cone. It also explores the diverse meanings of cohabitation from a cross-national perspective and examines the theoretical implications of recent developments on family change in the Americas. The book uses data from the Integrated Public Use Microdata Series, International (IPUMS), a project dedicated to collecting and distributing census data from around the world. This large sample size enables an empirical testing of one of the currently most powerful explanatory frameworks for changes in family formation around the world, the theory of the Second Demographic Transition. With its unique geographical scope, this book will provide researchers with a new understanding into the spectacular rise in premarital cohabitation in the Americas, which has become one of the most salient trends in partnership formation in the region.

Book Synopsis Marriage and Marriage-like Relationships by : Martha J. Bailey
Download or read book Marriage and Marriage-like Relationships written by Martha J. Bailey and published by . This book was released on 1999 with total page 196 pages. Available in PDF, EPUB and Kindle. Book excerpt: This paper looks at how Canada has responded to changing family forms and whether Canadian laws are consistent with social values & objectives. It compares the laws surrounding marriage with those governing marriage-like relationships, taking into account the social context in which family law now operates. The relationships examined in the report are opposite-sex cohabitation, same-sex cohabitation, and non-conjugal but affective & interdependent relationships between adults. The comparison between marriage & marriage-like relationships supports the analysis of this conceptual paper, which is aimed primarily at identifying the issues, assumptions, social objectives, and values underlying current laws, and the inconsistencies between social objectives & values and current laws. This examination reveals problematic issues and the paper discusses how the law addresses or fails to address them. The paper also examines selected developments in other western countries in relation to marriage & marriage-like relationships. This comparative analysis seeks to place the legal rules of different countries within a wider context and to focus on the legal discourse, the reform debates, and the way lawyers reason with the law.
Book Synopsis Biomedicine, the Family and Human Rights by : Marie-Thérèse Meulders-Klein

Available in PDF, EPUB and Kindle. Book excerpt: This volume examines the impact of advances in genetics and assisted reproduction technologies on family law, human rights and the rights of the child, including the effects of international treaties on national legislation. It surveys the theoretical, ethical and legal discussions with regard to biotechnology and family law issues and the search for a balance between safeguarding respect for human rights and fundamental freedoms and the need to ensure freedom of research. However, biotechnology impinges not only on isolated individuals and their rights, but also on unborn children, the family as a network of living relationships and the basic structure of any society, as well as the foundation of parentage and kinship, social organization as a whole and, finally, mankind itself. As the attention of the World turns to cloning, this book will contribute to the search for a balance between the rights and freedoms of born and yet to be born human beings and the quest for new technologies.

Book Synopsis The Law of Kinship by : Camille Robcis
Download or read book The Law of Kinship written by Camille Robcis and published by Cornell University Press. This book was released on 2013-04-05 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: In France as elsewhere in recent years, legislative debates over single-parent households, same-sex unions, new reproductive technologies, transsexuality, and other challenges to long-held assumptions about the structure of family and kinship relations have been deeply divisive. What strikes many as uniquely French, however, is the extent to which many of these discussions—whether in legislative chambers, courtrooms, or the mass media—have been conducted in the frequently abstract vocabularies of anthropology and psychoanalysis. In this highly original book, Camille Robcis seeks to explain why and how academic discourses on kinship have intersected and overlapped with political debates on the family—and on the nature of French republicanism itself. She focuses on the theories of Claude Lévi-Strauss and Jacques Lacan, both of whom highlighted the interdependence of the sexual and the social by positing a direct correlation between kinship and socialization. Robcis traces how their ideas gained recognition not only from French social scientists but also from legislators and politicians who relied on some of the most obscure and difficult concepts of structuralism to enact a series of laws concerning the family. Lévi-Strauss and Lacan constructed the heterosexual family as a universal trope for social and psychic integration, and this understanding of the family at the root of intersubjectivity coincided with the role that the family has played in modern French law and public policy. The Law of Kinship contributes to larger conversations about the particularities of French political culture, the nature of sexual difference, and the problem of reading and interpretation in intellectual history.
