Since its revival in the 1970s political philosophy has been a vibrant field in philosophy, one that intersects with jurisprudence, normative economics, political theory in political science departments, and just war theory. OSPP aims to publish some of the best contemporary work in political philosophy and these closely related subfields. This volume features eight papers that address a range of central topics and represent cutting edge work in the field. The three parts of the volume explore legitimacy, egalitarianism, and liberty and coercion.

Available in PDF, EPUB and Kindle. Book excerpt: Social enterprises represent a new kind of venture, dedicated to pursuing profits for owners and benefits for society. Social Enterprise Law provides tools that will allow them to raise the capital they need to flourish. Social Enterprise Law weaves innovation in contract and corporate governance into powerful protections against insiders sacrificing goals such as environmental sustainability in the pursuit of short-term profits. Creating a stable balance between financial returns and public benefits will allow social entrepreneurs to team up with impact investors that share their vision of a double bottom line. Brakman Reiser and Dean show how novel legal technologies can allow social enterprises to access capital markets, including unconventional sources such as crowdfunding. With its straightforward insights into complex areas of the law, the book shows how a social mission can even be shielded from the turbulence of an acquisition or bankruptcy. It also shows why, as the metrics available to measure the impact of social missions on individuals and communities become more sophisticated, such legal innovations will continue to become more robust. By providing a comprehensive survey of the U.S. laws and a bold vision for how legal institutions across the globe could be reformed, this book offers new insights and approaches to help social enterprises raise the capital they need to flourish. It offers a rich guide for students, entrepreneurs, investors, and practitioners.

Available in PDF, EPUB and Kindle. Book excerpt: No longer content with accepting whiteness as the norm, critical scholars have turned their attention to whiteness itself. In "Critical White Studies: Looking Behind the Mirror," numerous thinkers, including Toni Morrison, Eric Foner, Peggy McIntosh, Andrew Hacker, Ruth Frankenberg, John Howard Griffin, David Roediger, Kathleen Heal Cleaver, Noel Ignatiev, Cherrie Moraga, and Reginald Horsman, attack such questions as: *How was whiteness invented, and why? *How has the category whiteness changed over time? *Why did some immigrant groups, such as the Irish and Jews, start out as nonwhite and later became white? *Can some individual people be both white and nonwhite at different times, and what does it mean to pass for white? *At what point does pride in being white cross the line into white power or white supremacy? *What can whites concerned over racial inequity or white privilege do about it? Science and pseudoscience are presented side by side to demonstrate how our views on whiteness often reflect preconception, not fact. For example, most scientists hold that race is not a valid scientific category -- genetic differences between races are insignificant compared to those within them. Yet, the one drop rule, whereby those with any nonwhite heritage are classified as nonwhite, persists even today. As the bell curve controversy shows, race concepts die hard, especially when power and prestige lie behind them. A sweeping portrait of the emerging field of whiteness studies, "Critical White Studies" presents, for the first time, the best work from sociology, law, history, cultural studies, and literature. Delgado and Stefancic expressly offer critical white studies as the next step in critical race theory. In focusing on whiteness, not only do they ask nonwhites to investigate more closely for what it means for others to be white, but also they invite whites to examine themselves more searchingly and to look behind the mirror.

Available in PDF, EPUB and Kindle. Book excerpt: Global Justice and Our Epochal Mind explores the mind of our epoch, defined as the period since the Nuremberg Trial and the establishment of the United Nations in 1945. Xunwu Chen examines four defining ideas of this epoch—global justice, cosmopolitanism, crimes against humanity, and cultural toleration—as well as the structural relationships among these ideas. Chen argues that the mind of our epoch is essentially the mind of humanity. Its world view, horizon, standpoint, norms, standards, and vocabularies are of humanity, by humanity, and for humanity, and all are embodied in human institutions and practices throughout the globe. Meanwhile, our epochal mind has a dialectical relationship with particular cultures bearing normative force. As a metaphysical subjectivity and substance, humanity is the source of all human values in our epoch and defines what can and should be human values and virtues. Humankind, therefore, are a people with socio-political and legal sovereignty, sharing a common fate. This novel study brings a cross-cultural approach and will be of great interest to students and scholars of philosophy, political science, sociology, and the humanities more broadly.

Book excerpt: This comprehensive book traces the growth of labour jurisprudence in India and provides a clear understanding of the content of these principal judgements. The Supreme Court of India has always had pro-socialist judges, the most prominent of them being Justice V R Krishna Iyer. His contributions to labour jurisprudence are legendary. This book analyses and critiques the most important judgements delivered by Justice Iyer from the perspective of social justice. The judgements are arranged contextually in accordance with the subject and within the framework of prevailing industrial laws. The authors elaborate on the key aspects of industrial relations in India and provide a clear understanding of the linkage between labour issues and the philosophy of the Constitution as perceived by Justice V R Krishna Iyer.

Book excerpt: This study explores and critiques law and law making in the nascent constitutional democracy in the new South Africa, with a focus on the complex roles of the executive, parliament, political parties, the media and civil society. The capacity and potential in the judiciary and the legal profession in promoting and protecting values and rights of equality and non-discrimination is examined. Substantive equality and non-discrimination law in theory and in practice is considered critically, from a broad historical and social context that highlights areas of race, gender, disability, harassment and hate speech, socio-economic rights, and legal services. International human rights law and comparative law aspects are skillfully interwoven in this pioneering scholarly work.

Book excerpt: In postwar Canada, having a child out-of-wedlock invariably meant being subject to the adoption mandate. Andrews describes the mandate as a process of interrelated institutional power systems which, together with socio-cultural norms, ideals of gender heteronormativity, and emerging sociological and psychoanalytic theories, created historically unique conditions in the post WWII decades wherein the white unmarried mother was systematically separated from her baby by means of adoption. This volume uncovers and substantiates evidence of the mandate, ultimately finding that at least 350,000 unmarried mothers in Canada were impacted.
