Excerpt: ...no need of inserting in the act that the commission should reconvey to the city. The learned counsel for the respondents admits that an equity of redemption reposed in the city. When therefore the debt should become paid, the new city hall would be absolutely the property of the city.' There appears upon the brief of respondents this assertion: "In many cases, where commissioners, not being incorporated, have issued bonds, the courts have held that the city was liable, as the statutes properly construed required a holding that such unincorporated commissioners were simply agents of the city." We can see no reason why an incorporated commission may not act as an agent or trustee just as well. An examination of the various sections of the legislative act reveals the fact that the commission was to be but the humble trustee of the city of Waterville, and the city itself the real owner of the property. The commission as created by the act was naked of all authority excepting in just one respect, and that was as a formal medium through which the city could secure to the bondholders its debt. It will be seen all the way along that the commission is to be under the control of the city. The commission could sue and be sued, but it had no property and was subjected to no risks. It is entitled to have certain officers, and such others "as the city may direct." The city treasurer is to be the treasurer of the commission, but no new bond is required of him, and his sureties would not be responsible for his defaults, unless he be considered as acting for the city in what he does for the commission. Section 2 declares that the powers and duties of the commission shall be controlled by the city. The commission is to have...

Excerpt: ... the defendant was in possession of the premises, or any part thereof at the time of the commencement of the action. All the evidence as to both points was left to the jury, with instructions as to the facts necessary to constitute a disseizin. The counsel for the demandants requested the Chief Justice, who presided at the trial, to instruct the jury that, the recording of the defendant's deed a short time before the action was commenced, with his aforesaid declarations as to his fence, were suflicient evidence of his being in possession when the action was commenced, unless said evidence was in some way explained or contradicted. But the Judge declined giving such a definite instruction. The jury returned a verdict in favour of the defendant, in the following words: " The jury find "that the defendant has held quiet possession of the demand" ed premises for more than 20 years at one time after the year " 1783. The jury further find for the defendant upon the " ground that he was not in possession of the demanded prem" ises at the time of the commencement of this action." The demandant's counsel filed a motion fora new trial predieating it on the following reasons. 1. " Because the verdict Von. 1. 33 " does not find the issue joined by the parties, and which was " submitted to the jury." " 2. Because the facts that they have found, are immaterial." " 3. Because the jury have not found that the tenant either " did or did not disseize the said demandants, which was the " only issue submitted to them." " 4. Because the finding of the jury is contrary to the evi" dence in the case, and against the weight of...

They act upon their own responsibility and are not subject either to the control or direction of the inhabitants of the town, "but are an independent board of public officers, vested by law with the control of all matters within their jurisdiction, and performing duties imposed by general law." In this respect they are a part of the municipal government, in the performance of their public duties, and are not servants or agents of the municipality by whom they are chosen and paid, rendering their principals liable for their acts, any more than are officers of a fire department, (Burrill v. ' ' The mandate of 5, is not, as plaintiffs' counsel assumes, to proceed at such time as is prescribed in 527, but "in the manner" therein provided. The commissioners were justified in proceeding when, and as they did after notice to the town, upon petition of those interested, to cause the work to be done by an agent not one of themselves. That agent made his written contract for the work and filed a copy of it in the clerk's ofiice and the commis sioners certified to the assessors of Waterville the time when the contract was to be completed and the amount to be paid therefor. So far the proceedings of the commissioners were warranted by the authority which the act confers upon them, and if they had continued throughout to proceed in the manner provided in 27, c. 18, R. S. of 1857, which is identical with 28, c. 18, R. S. of 1871, the plaintiffs would have had no just cause of complaint. _ But our attention has been called to some irregularities in these proceedings which we deem fatal to the defendants' justification. The commissioners did not proceed in the manner prescribed-in said 27, when they issued the first warrant of distress May 2, 1871, the next day after the one fixed for the completion of the contract. It is not in the power of the agent appointed or the party with who_m he contracts, by finishing his work and procuring the allowance of his accounts within the time fixed for the completion of the contract, to hasten the day of payment. The town is to be notified when the contract is made, of the time fixed for its completion. We think the true construction of the statute is that the liability of the town to pay accrues only at the expiration of the time...

Excerpt: ...able and instructive opinion, held that neither at common law, nor under the constitution of the United States, had the jury any right to judge of the law. This was in the Circuit Court of the United States for the District of Columbia. In a. criminal case tried in the Circuit Court of the United States, in the city of New York, Mr. Justice TIIOMPSON, when requested to charge the jury that they were judges of the law as well as the facts, briefly, but not ambiguously, answered: "I shunt: they aint." 2 Whar. Criminal Law, 3100. In Pierce v. The Stale, 13 N. I-I., 536, the indictment charged a violation of the Act regulating the sale of wines and spirituous liquors. The defend.-int's counsel contended that the jury were the judges of the law as well as the facts in the case; that it was their duty to judge of the constitutionality of the Act, and to form their own opinion upon that question, and that the Court had no right to z'n.'/ruct them in relation to questions of law, --it could only mlvise them. The Court held that the jury were notjudgcs of the law in criminal cases. "Ve cannot believe," said the Court, " that impartial and reflecting men, of whatever profession they may be, can advocate doctrines which may lead to such results as the right of the jury to decide the law may end in. " " No reflecting man in the jury box would he villing to take upon himself this responsibility. " "' " And it is the opinion of the Court, that it is inconsistent with the spirit of the constitution that 'questions of law, and still less questions of constitutional law, should be decided by the verdict of the jury, contrary to tho instructions of the Court.."
