El proceso de transformación digital y la informatización de los puestos de trabajos, que la pandemia COVID-19 ha acelerado, han puesto de relieve la exposición del trabajador a nuevos riesgos, vinculados a una conectividad cada vez más intensa, que también aumenta en extensión. La práctica acumulada ha alimentado el debate en torno a la necesidad de su protección y, en este contexto, se aprueba en nuestro ordenamiento el RD28/2020, llamado a regular el teletrabajo moderno y hoy transformado en la L10/2021. El trabajo digitalizado está desfigurando las coordenadas de espacio y tiempo que, históricamente, han delimitado el alcance y contenido de las obligaciones y responsabilidades en materia de prevención de riesgos. Es necesario ofrecer nuevas perspectivas para la observación del teletrabajo, valorar las razones de su cambiante despliegue y reparar en el evidente déficit de tutela jurídica en su primer medio siglo de recorrido. Desde esta óptica, la presente obra pretende contribuir a estimular el debate sobre posibles contingencias y prioridades jurídicas relacionadas con su aplicación, a partir de una exploración contextualizada del marco jurídico en materia de seguridad y salud del teletrabajo.

A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.
