Book excerpt: La mayoría de los países de Latinoamérica han ratificado el Convenio 169 del OIT sobre Pueblos Indígenas y Tribales en Países Independientes y la Convención Americana de Derechos Humanos, y casi todos los países del hemisferio votaron por la Declaración de las Naciones Unidas sobre los derechos de los pueblos indígenas (2007), que consagra la obligación de los Estados de participar en procesos de consulta con sus pueblos originarios antes de tomar acciones que afectan a sus comunidades, territorios o recursos. A pesar de asumir estas obligaciones, la mayoría de gobiernos han sido lentos en darles efecto. Por lo cual, en más de dos docenas de fallos, los tribunales superiores de la región han cuestionado o anulado decisiones importantes de los gobiernos por falta de cumplimiento de los requisitos de consulta. Como respuesta, varios gobiernos han impulsados procesos para “reglamentar la consulta” a través de varios mecanismos, con resultados diversos en términos de efectividad. En cualquier caso, una cuestión básica es que los gobiernos tengan la voluntad política de abrir los procesos de decisión con sus pueblos originarios, fundamentados en la implementación de estándares internacionales.
