Available in PDF, EPUB and Kindle. Book excerpt: The Constitutions that Shaped Us re-examines from a comparative and critical standpoint the events, key players, and texts which, taken together, help to interpret all Canadian constitutions prior to Confederation. The key constitutional documents that are studied in this book are the Royal Proclamation of 1763, the Quebec Act of 1774, the Constitutional Act of 1791, and the 1840 Act of Union. Great Canadian historians of the past take turns in providing unforgettable sketches and understandings of the actions of monumental figures such as Governors Murray, Carleton, and Elgin, British politicians from Pitt to Burke, Grey, and Durham, without forgetting the leading political and intellectual colonial figures such as Bédard, Papineau, La Fontaine, Mackenzie, and Baldwin. Gathering together the most renowned and representative works of constitutional scholarship, this anthology provides readers with an in-depth account of the events that would ultimately lead to the union of British colonies, the birth of the Dominion of Canada, and the rebirth of political autonomy in a colony known successively as Quebec, Lower Canada, Canada East, and once again Quebec in 1867. Following a general survey of the various constitutions enacted under British rule, this collection includes an equal number of commentaries by French- and English-speaking historians concerning each of the four constitutions to offer the most nuanced view of Canada’s origins to date.

Book Synopsis Roads to Confederation by : Jacqueline D. Krikorian
Download or read book Roads to Confederation written by Jacqueline D. Krikorian and published by University of Toronto Press. This book was released on 2017-10-31 with total page 395 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recognition of Canada’s sesquicentennial, this two-volume set brings together previously published scholarship on Confederation into one collection. The editors sought to reproduce not only the "classic" studies about the people, ideas, and events associated with the passage of the British North America Act, 1867, but also scholarly works that capture the complexities of the Confederation project. This ambitious anthology challenges the notion that there exists one dominant narrative underpinning 1867, and includes research that focuses on Indigenous peoples. Seven articles written in French are translated for the first time for publication in this collection. In the first volume of this anthology, Roads to Confederation introduces readers to the competing approaches to the study of Confederation and provides material that considers the nature of the 1867 project from the perspective of peoples and communities who have been traditionally excluded from the literature. It also includes the definitive scholarship on the ideational underpinnings of the making of Canada as well as several leading articles that set out different ways to understand the nature and purpose of the 1867 agreement.

Book Synopsis Comparative Federalism in the Devolution Era by : Neil Colman McCabe
Download or read book Comparative Federalism in the Devolution Era written by Neil Colman McCabe and published by Lexington Books. This book was released on 2002 with total page 376 pages. Available in PDF, EPUB and Kindle. Book excerpt: The decline of statism as the world's dominant ideology has ignited a fierce debate over the evolving shape and power of federalism in global society. The popular demand for devolution has shifted the locus of power from national government to smaller regional units and heralded the reconceptualization of international law away from the idea of sovereignty, toward one of jurisdiction. This timely set of essays studies the impact wrought by these centrifugal forces across Europe, Africa, and the Americas, and analyzes the latest movements for constitutional change, self-determination, and separation. Comparative Federalism in the Devolution Era offers political scientists and legal scholars a new perspective on the diverse nature and exercise of postmodern federalism, and the continuing struggle between differing views of the national-local relationship.
Book Synopsis The Strategic Constitution by : Irvin Studin
Download or read book The Strategic Constitution written by Irvin Studin and published by UBC Press. This book was released on 2014-05-15 with total page 285 pages. Available in PDF, EPUB and Kindle. Book excerpt: Historically, Canada’s Constitution has been principally viewed as a federal framework or a rights bulwark. This book offers a brand new interpretation. The “Strategic Constitution,” as proposed by Irvin Studin, can be a framework for Canada to project strategic power in the world. This framework lays the foundations for a new school of Canadian constitutional scholarship. Studin begins by reducing the Constitution to its strategically relevant essentials or building blocks. He then provides a wide-ranging audit of the Constitution in terms of its implications for so-called factors of strategic power: the military, diplomacy, executive potency, natural resources, the economy, strategic communications, and the national population. He later applies the Strategic Constitution framework to four policy case studies: Canadian regional leadership in the Americas; bona fide war (as in Afghanistan); Arctic sovereignty; and counterterrorism. Provocative and well-argued, this book makes the case for the Constitution being a highly flexible national framework that quietly harbours seeds of national strategic potency.
