C'est surtout pour les prothèses dentaires que quelques arrêts récents ont fait apparaître l'idée que le médecin devait non pas guérir impérativement le malade mais lui garantir un résultat pour la prothèse qu'il fournit. L'obligation de sécurité a resurgi avec les procès en responsabilité intentés dans l'affaire du sang contaminé. D'où vient cette obligation de sécurité ? Qui en est le titulaire : le fournisseur, l'acquéreur ou le médecin prescripteur ? Quant à sa nature, elle pose aujourd’hui des difficultés tant à la jurisprudence qu'à la doctrine. Est-elle une obligation de résultat ? Une modalité particulière de l'obligation de moyens ? Un mélange des deux ? Pour ce qui est des titulaires de la responsabilité, il y a une évolution importante. La nature de l'obligation de sécurité, qui en revanche continue de diviser la doctrine et la jurisprudence, n'est toujours pas bien établie. La tentation est grande de l'analyser pour des raisons indemnitaires comme une obligation de résultat, mais nous ne pouvons y souscrire. L'obligation de résultat signifie que quoi qu'il arrive, le médecin doit aboutir au résultat. Une telle obligation ne peut pas exister en matière médicale, car le risque nul n'existe pas et n'existera sans doute jamais, l'activité médicale sera toujours soumise à un irréductible aléa.

Book excerpt: Si la jurisprudence communautaire est essentielle dans l’élaboration de la définition et du régime juridique du principe de précaution sanitaire, le domaine de la santé humaine offre à ce principe une histoire autonome de l’environnement et spécifique. Cette histoire éclaire la dimension juridique du principe qui émerge. L’existence et la signification de cette notion de précaution implicite s’établissent au travers d’un mécanisme que nous nommons la « réification ». La réification de la précaution dans un produit ou un objet permet la protection des personnes contre les dangers de cette chose. Elle répond à l’impossibilité juridique de consentir à l’incertitude scientifique. Dans le domaine de la santé, la définition du médicament est l’exemple majeur de l’existence d’une précaution réifiée. Mais, elle est aussi présente dans le droit de la responsabilité civile avec l’obligation de sécurité résultat appliquée au sang, aux produits de santé et aux infections nosocomiales. Cette forme de la précaution permet au principe de prudence de bénéficier d’une certaine autonomie par rapport à la preuve scientifique. Rapprochée du principe de précaution, cette notion de précaution sanitaire aide à le caractériser. Ce principe est composite. Sa définition comprend deux obligations, une obligation d’évaluation et une obligation de prévention. Son régime juridique relève du droit public mais aussi du droit privé. Sa fonction est préventive mais aussi réparatrice. C’est dire qu’il est aussi un principe complexe. Avec l’émergence du principe, la précaution prend son autonomie de l’objet. Une nouvelle forme juridique de protection du patient se dessine en prospective. Une définition spécifique de l’obligation déterminée d’évaluation apparaît qui doit trouver sa place par rapport à l’obligation générale de prudence. Leur définition et leur champ d’application sanitaires attendent d’être consacrés par le législateur non seulement en droit public, mais aussi en droit privé.
