Obiettivo principale è quello di stimolare una riflessione sui processi di risocializzazione e sulle dinamiche che ad essi sottendono, partendo da un'analisi del soggetto deviante, di tipo sociologica, criminologica e giuridica, cercando di spiegare gli atteggiamenti della società civile nei confronti del reo, gli strumenti atti al recupero del deviante, l'impatto che l'istituzione totale ha sugli individui ed i meccanismi che stanno alla base del concetto di rieducazione, di reinserimento sociale e lavorativo dei detenuti.Il manoscritto è stato suddiviso in tre parti: nella prima parte, consapevoli di non poter approfondire la sociologia della devianza in maniera esaustiva, vengono proposte alcune riflessioni su aspetti teorici e su diversi Autori che hanno delineato i caratteri devianti in ambito sociologico e criminologico, con lo scopo di individuare corrispondenze e punti di interconnessione tra società, identità deviante, scopo della pena e processi di risocializzazione. La seconda parte della monografia percorre, attraverso un'analisi storica ed evolutiva, le dinamiche giuridiche e la complessità delle tematiche che si intrecciano attorno al "sistema carcere," con una puntuale disamina delle misure alternative alla detenzione e, in particolare, del ruolo dell'Assistente sociale nell'ipotesi di affidamento del soggetto in prova ai servizi sociali. L'ultima parte è incentrata su un'analisi di ricerca volta ad evidenziare il sistema penitenziario nel suo complesso, con particolare riferimento al ruolo delle attività trattamentali, intramurali ed extramurarie, ai progetti virtuosi posti in essere dal privato sociale, in collaborazione con il Dipartimento dell'Amministrazione Penitenziaria (DAP), che hanno accompagnato alcuni ex detenuti al pieno reinserimento sociale. In particolare, ci si è concentrati su un progetto sociale integrante che ha condotto fuori dal carcere malati psichiatrici autori di reato dell'ex Ospedale Psichiatrico Giudiziario di Barcellona Pozzo di Gotto, attraverso percorsi di empowerment sociale, che ha consentito loro un lavoro e una vita dignitosa.In ultimo, si è cercato di trattare alcuni aspetti relativi al tema del reinserimento sociale dei detenuti, in virtù della crescente attenzione posta soprattutto a livello europeo e, in particolare, attraverso l'utilizzo di strumenti finanziari e programmi specifici finalizzati. Ho completato il lavoro di studio somministrando un'intervista al Direttore della Casa Circondariale di Barcellona Pozzo di Gotto, dott. Nunziante Rosania, su alcuni temi quali: la collaborazione dell'istituto carcerario con il territorio, i progetti di reinserimento lavorativo dei detenuti e le difficoltà del sistema penitenziario di garantire un pieno recupero e reinserimento lavorativo e sociale dei soggetti con alle spalle percorsi penali.Pertanto, l'elaborato senza alcuna pretesa di esaustività, intende offrire un contributo ad un'analisi sociologica, giuridica e criminologica, partendo dal presupposto che una società civile possa evolversi solamente se capace di liberarsi dallo stigma sociale che sempre più coinvolge migranti, detenuti e malati psichiatrici, considerati "gli Altri" per eccellenza.

Infatti, l'occupazione rappresenta il passaggio critico per concretizzare gli obiettivi di riabilitazione e reintegrazione sociale richiesti dalla Costituzione, consentendo di intraprendere percorsi di vita al di fuori degli ambienti e delle attività illegali. Questo è dovuto alle difficoltà di natura legale, organizzativa e culturale presenti nell'ambiente penitenziario. In questo contesto, la dimensione sociale e quella lavorativa sono strettamente interconnesse, e ciò è particolarmente evidente rispetto ad altri settori. Questa interconnessione è cruciale per prevenire il rischio elevato di recidiva e per evitare che le persone detenute siano coinvolte nuovamente nell'esclusione sociale e nell'emarginazione. Pertanto, nell'ottica di riabilitare le persone sottoposte a pena, la formazione e il supporto nell'accesso al lavoro rappresentano elementi essenziali nel processo di reintegrazione sociale. L'avvio al lavoro, sia all'interno delle strutture carcerarie sia al momento del rilascio, costituisce un aspetto fondamentale per ridurre il numero di reati ripetuti e per agevolare il ritorno alla vita al di fuori delle mura carcerarie. Il reinserimento nella società delle persone detenute richiede un percorso di rieducazione in cui il lavoro assume un ruolo di primo piano. Secondo le statistiche del Consiglio Nazionale dell'Economia e del Lavoro, solo il 2% dei detenuti che hanno avuto l'opportunità di trovare un impiego ricade nella criminalità, mentre la percentuale di reincidenza sfiora il 70% per coloro che non hanno avuto questa opportunità. Il lavoro rappresenta un pilastro fondamentale nel processo di rieducazione, essenziale per garantire e promuovere la dignità individuale. Con l'approvazione della riforma penitenziaria nel 2018, il legislatore ha nuovamente cercato di colmare il divario tra il lavoro in carcere e quello svolto al di fuori, riconoscendo che solo un'occupazione organizzata secondo gli standard della società libera può fornire le competenze e la formazione professionale necessarie per un efficace reinserimento dei soggetti detenuti nella comunità.
