Dans la deuxième partie, qui étudie le droit pénal de forme sont énoncés les principes généraux qui jouent un rôle dans les droits de la défense et dans la protection juridictionnelle. Cette partie comprend le principe du contradictoire, les droits des personnes poursuivies, le principe de confidentialité, le principe de l'inviolabilité du domicile et, le principe selon lequel nul n'est contraint de témoigner contre soi-même. Enfin, nous trouvons aussi le principe d'égalité des personnes dans l'accès à la justice et dans la poursuite des infractions. A savoir que toute personne a droit à un recours juridictionnel, que le communautaire tient le criminel en l'état.
