Encontram-se, também, outras normas proibindo a ingerência do autor da herança na legítima dos herdeiros necessários, só permitindo a lei, a imposição de cláusulas de impenhorabilidade, incomunicabilidade e inalienabilidade em casos especiais, provada em juízo. A sucessão testamentária tornou-se dinâmica e o testamento público assemelha-se mais à escritura pública que aos antigos conceitos do testamento romano. O legislador introduziu testamento elaborado em circunstâncias excepcionais, como testamento particular, sem a necessidade da presença de testemunhas.
