Simultanément, l'idéé de réaliser une grand marché commun a abouti à la constitution d'une entité économique entre six pays signataires. Parmi les dispositions du Traité de Rome, la libre circulation des personnes était capitale pour la réalisation du marché commun. Seule l'Italie était en position de fournisseur de main d'oeuvre mais elle ne pouvait couvrir les besoins importants des autres pays membres. Ceux-ci ont recherché individuellement la main d'oeuvre dont ils avaint besoin et signé une série d'accords avec des pays tiers : Espagne, Portugal, Turquie et pays d'Afrique du Nord. Une population importante s'est donc établie d'une manière durable dans les pays de la CEE. Au milieu des années 70, l'augmentation du taux de chômage dans les pays membres a entraîné la suspension de toute migration extra-communautaire. De nombreuses restrictions sur les conditions de séjour et de travail ont touché la main d'oeuvre originaire de pays non membres. Par contre, les migrants intra-communautaires n'ont pas eu à souffrir d'une atteinte à leurs droits puisqu'ils étaient garantis par le droit communautaire. Cette situation a coincidé avec l'élargissement de la CEE à des pays traditionnellement fournisseurs de main d'oeuvre (Espagne et Portugal). Concernant les ressortissants des pays tiers établis depuis de nombreuses années, dans les différents pays membres, la situation juridique peut être améliorée en cas d'harmonisation des législatoins nationales. Dans un domaine aussi sensible que le droit des étrangers où, généralement, les Etats désirent conserver leurs prérogatives nationales, une politique comunautaire active pourrait entraîner la mise en place d'un statut juridique du migrant progressiste et commun à tous les pays membres.
