Book excerpt: The book starts from the premise that the current aviation framework, in Brazil, cannot sustain a full liberalisation in the long run. While the competition rules in place offer a strong framework, which only requires small modifications, these rules are not "enough" to foster a "healthy" liberalisation. In fact, until recently, Brazilian airlines were operating in a homogenous market, where competition was artificial. This artificial competition, obtained through the imposition of a legal obligation to provide water and a snack and grant a 23kg bag allowance, has resulted in a highly concentrated domestic market with very few players. Compared to other same size markets, such as China or India, Brazil is far behind in terms of airlines operating at national level. Consequently, the opening of the domestic market must be closely regulated to avoid national carriers suffocating under external pressure. For this reason, state intervention during the liberalisation process is crucial. State intervention is also with regard to the protection of passengers. The other major problem is the protection framework for passengers which is much too uncertain and burdensome. In a sense, it is detrimental to the domestic market and passengers. Indeed, there is no harmonisation of passenger compensation leading to contradictory judgments and possible high moral damages which hinders legal certainty for airlines. Compared to the situation in the EU, in Brazil, airlines have a limited range of defences, which are often dismissed by courts. This book, therefore, critically analyses the policies and regulations in place by mainly comparing the Brazilian framework to the European one. This choice has been motivated by the fact that European liberalisation is considered the best so far, and as Brazil is starting this process much later, it could benefit from the European experience. The major arguments for liberalisation were in general a reduction of capacity constraints and a simplified market access (Himpel & Lipp 2006, p.26). Constitutional for these ideas is the theory of contestable markets which assumes the efficiency of competition with a free market entry and market exit. Therefore deregulation processes aim at providing a better, safer and more efficient industry. However, Geoffrey Thomas (2008) among others points out that in reality the liberalisation of air transportation has caused predominantly negative outcomes which is why there should be a return to some degree of regulation. Based on Thomas’ train of thoughts, this research paper is aimed at critically evaluating the effects of liberalisation both on the aviation industry and on the consumer. The paper is therefore structured as follows: after revealing the limitations of the evaluation, positive effects of liberalisation in Europe, the United States and Australia are outlined which are then opposed to negative effects. Based on these findings, a conclusion is finally drawn.

Ten years ago, the practical collaboration was begun of bringing together people who belonged to the complementary streams of economic analysis and policy analysis presented int his book. During this time, we opened discussions on the relationship between transportation technology, transportation economics and transportation policy under the general auspices of the Canadian Royal Commission on National Passenger Transportation. Working over a 40-month period (1989-1992), this Commission took stock of transportation and produced an up-to-date `État de la question' and policy framework (Hyndman, et al, 1992). Clearly, the project committee's discussions on air policy, over the period 1995-1997 (see Chapter 8), outlined the possibilities for a mechanism to understand the differences about the desirability of air liberalisation, as well as the possible TEP interactions in this area. This led to an exploratory first formulation and computer programme (HLB, 1997) incorporating the approach outlined in Chapter 15. A joint celebration of the CRT's 25th birthday and Transport Canada's 60th birthday seemed appropriate to bring together the various streams. Part I of Taking Stock of Air Liberalization looks at the record, and Part II focuses on specific impacts of policies. Policy formulation (Part III) and the required tools (Part IV - Modelling Demand) are also discussed in this context. The book ends with perspectives in Part V - The Future Market Structure and Public Policy. The competition among airlines is rapidly spreading to the competition among airports, and the difficult regulation of these strategic spatial monopolies (which is introduced in Chapter 13) is now attracting research activity. The next discussion in the airline industry will be the role of airports.
