Available in PDF, EPUB and Kindle. Book excerpt: Undeclared Wars with Israel examines a spectrum of antagonism by the East German government and West German radical leftist organizations - ranging from hostile propaganda and diplomacy to military support for Israel's Arab armed adversaries - from 1967 to the end of the Cold War in 1989. This period encompasses the Six-Day War (1967), the Yom Kippur War (1973), Israel's invasion of Lebanon in 1982, and an ongoing campaign of terrorism waged by the Palestine Liberation Organization against Israeli civilians. This book provides new insights into the West German radicals who collaborated in 'actions' with Palestinian terrorist groups, and confirms that East Germany, along with others in the Soviet Bloc, had a much greater impact on the conflict in the Middle East than has been generally known. A historian who has written extensively on Nazi Germany and the Holocaust, Jeffrey Herf now offers a new chapter in this long, sad history.

Available in PDF, EPUB and Kindle. Book excerpt: A number of commentators assert that the military response to the terrorist atrocities of 11 September 2001 - encompassing attacks on Afghanistan and Iraq, and commonly referred to as the 'war on terror' - has significantly impacted upon the international law regulating resort to armed force by states (jus ad bellum), loosening the constraints on self-defence. Some even suggest that the very future of the United Nations, in particular the Security Council and its collective security system, is at risk - at least in its current form. This book does not address the question of the future of the United Nations, an issue probably best left to scholars of international relations. Instead, it seeks to place the 'war on terror' within the context of international law, assessing how, or whether, it can be accommodated within the existing legal framework limiting the use of force. Through an examination of the lawfulness (or otherwise) of both Operation Enduring Freedom and Operation Iraqi Freedom, including the legal justifications advanced by those states involved and the reaction of the international community, and involving a detailed discussion of the most important developments (ie, the permissibility of self-defence against non-state, terrorist, actors and the 'Bush doctrine' of pre-emptive self-defence against terrorists as proclaimed in the 2002 US National Security Strategy) the book determines whether, and to what extent, the right to use force - or the acceptability of such military action - is currently undergoing a radical transformation. By assessing subsequent developments illustrating the impact that military action against Afghanistan and Iraq has had on the jus ad bellum, this book represents a distinctive and original contribution to the academic literature.

Book Synopsis International Law and the War with Islamic State by : Saeed Bagheri
Download or read book International Law and the War with Islamic State written by Saeed Bagheri and published by Bloomsbury Publishing. This book was released on 2021-07-15 with total page 217 pages. Available in PDF, EPUB and Kindle. Book excerpt: Armed non-state actors (ANSAs) often have economic aims that international law needs to respond to. This book looks at the aim of Islamic State to create an effective government, with an economically independent regime, which focused on key oilfields in Syria and Iraq. Having addressed Islamic State's quest for energy resources in Iraq and Syria, the book explores the lawfulness of the war with Islamic State from a variety of legal aspects. It has been attempted to make inroads into the most controversial aspects of contradictions in the application of jus ad bellum and jus in bello, particularly when discussing the use of extraterritorial armed force against ANSAs, and the obligation to protect civilian objects, including the natural environment. The question is whether the targeting of energy resources should be regarded as a violation of the laws of armed conflict, even though the war with Islamic State being classified as a non-international armed conflict. Ambitious in scope, the study argues that legal theory and state practice are still problematic as to how and under what conditions states can justify resorting to military force in foreign territory, and to what extent they can target natural resources as being part of state property. Furthermore, it goes on to examine the differences between international and non-international armed conflicts, to establish whether there is any difference in the targeting of energy resources as part of the war-sustaining capabilities of either party. Through an examination of the Islamic State case, the book offers a comprehensive study to close the gaps in jus in bello by contextualising the questions of civilian protection, victimisation and state responsibility by evaluating the US's war-sustaining theory as a justification for the destruction of a territorial state's natural resources that are occupied by ANSAs.
