Book excerpt: By the beginning of 1964 public debate about the terms on which French and English culture could continue to co-exist within a single Canadian federal state had become intense. Many causes could be assigned for the intensity of the debate, but one of them evidently was the lack of clear formulation of the problems. It was in these circumstances that the Association of Canadian Law Teachers and the Canadian Political Science Association used their annual meeting at Charlottetown in 1964 to get, on each of four aspects of the current problem of Canadian federalism, a vigorously reasoned statement, by a French-Canadian and an English-Canadian scholar, of the essentials of the problem as he saw it and then, by way of invited commentaries, to bring the ideas more fully into play. The four aspects were: competing concepts of federalism, economic problems peculiar to our federal state, legal and political attitudes towards the BNA Act, and institutional problems of a revision of the Act.

Book excerpt: Beginning with an examination of the role of traditional institutions such as Parliament, Cabinet, the Supreme Court, and political parties, Canada: State of the Federation 2002 affirms the long-held belief that these bodies do not provide effective forums for interregional bargaining, creating a void that has been filled at least in part by executive federalism. Contributors conclude that the performance of traditional institutions, taken as a whole, has deteriorated over the last several decades, placing more pressure on the processes of executive federalism.

Book excerpt: Marking 150 years since Confederation provides an opportunity for Canadian international law practitioners and scholars to reflect on Canada’s rich history in international law and governance, where we find ourselves today in the community of nations, and how we might help shape a future in which Canada’s rules-based and progressive approach to international law gains ascendancy. This collection of essays, each written in the official language chosen by the authors, provides a thoughtful perspective on Canada’s past and present in international law, surveys the challenges that lie before us, and offers renewed focus for Canada’s pursuit of global justice and the rule of law. Part I explores the history and practice of international law, including sources of international law, Indigenous treaties, international treaty diplomacy, domestic reception of international law, and Parliament’s role in international law. Part II explores Canada’s role in international law, governance and innovation in the broad fields of economic, environmental, and intellectual property law. Part III explores Canadian perspectives on developments in international human rights and humanitarian law, including judicial implementation of these obligations, international labour law, business and human rights, international criminal law, war crimes, child soldiers, and gender. Reflections on Canada’s Past, Present and Future in International Law/Réflexions sur le passé, le présent et l’avenir du Canada en droit international demonstrates the pivotal role that Canada has played in the development of international law and signals the essential contributions the country is poised to make in the future.

Available in PDF, EPUB and Kindle. Book excerpt: The Multilevel Politics of Trade presents a timely comparative analysis of eight federations (plus the European Union) to explore why some sub-federal actors have become more active in trade politics in recent years. As the contributing authors find, there is considerable variation in the intensity and modes of sub-federal participation. This they attribute to three key factors: the distinctive institutional features of federal systems; the nature and scope of trade policy and trade agreements; and the extent of social mobilization that accompanies a particular trade policy conversation. As a whole, The Multilevel Politics of Trade argues that sub-federal actors’ interests (jurisdictional, political, and economic) are what motivate them to participate in trade debates. However, institutional configurations, coupled with the influence of civil society actors, political parties, and others determine the nature and scope of that participation. Informed by a deep knowledge of federal dynamics, this volume provides extensive comparative analyses of all seven of the North American and European federations and represents a significant intervention into the study of both federalism and political economy.

Book excerpt: In October 2015, the federal Liberals came to power with sweeping plans to revamp Canada's democratic and federal institutions - a modernizing agenda intended to revitalize Canada's democratic architecture. The centrepiece of the agenda was the replacement of Canada's first-past-the-post electoral system, but they also promised to revitalize relations with the provinces, bring Indigenous Peoples into the intergovernmental fold, and to change the ways in which senators and Supreme Court justices are appointed. How has the reform agenda faired? Has it resulted in a more effective and democratic set of political and federal institutions? Or has it largely failed to deliver on these objectives? What, more broadly, is the state of Canada's democratic and federal institutions? The Queen's Institute of Intergovernmental Relations used the occasion of Canada's 150th birthday to examine these pressing issues. The 2017 volume in the State of the Federation series focuses on enduring questions about the functioning of federalism and intergovernmental relations in Canada, including how we should evaluate the quality of Canada's institutions and practices in light of our federal structure, and how current institutional arrangements and their possible alternatives fare according to these criteria.

Book excerpt: The "African Yearbook of International Law" provides an intellectual forum for the systematic analysis and scientific dissection of issues of international law as they apply to Africa, as well as Africa's contribution to the progressive development of international law. It contributes to the promotion, acceptance of and respect for the principles of international law, as well as to the encouragement of the teaching, study, dissemination and wider appreciations of international law in Africa. A clear articulation of Africa's views on the various aspects of international law based on the present realities of the continent as well as on Africa's civilization, culture, philosophy and history will undoubtedly contribute to a better understanding among nations. The "African Yearbook of International Law" plays an important role in examining the tensions underlying the State in Africa, and by shedding more light on the causes of the fragility of African State institutions so as to facilitate the identification of appropriate remedies. The tension and interrelationships among issues such as territorial integrity, self determination, ethnic diversity and nation-building are constantly addressed. Development, human rights and democratization in Africa are also the subject of continuous attention and examination. The "Special Theme" of this volume is "Regional Economic Integration in Africa II,"

Book excerpt: Modern states - and novel multinational polities such as the European Union - have to contend with greater degrees, and more complex forms, of diversity. What elements keep complex, «post-national», political entities together? What are the ties that bind people together in a world where they cannot rely on the safety of established national identifications (if they ever could)? This collection of essays by leading political scientists, philosophers and legal academics from Canada and Europe provides a transatlantic dialogue on the ways in which complex states (such as Canada) and non-states (the EU) may broach the modes of difference and diversity that confront them. Authors engage in insightful «diagnoses» of contemporary forms and modes of diversity, as well as critical appraisals of a number of normative responses meant to answer these challenges. These responses range from «reasonable accommodation» and multinationalism to cosmopolitanism. They include the recognition of «post-national», «multinational» or «deterritorialised» democracy and constitutional patriotism, as well as plural or «denationalised» citizenship.
