In that same vein, the paradigm proposed by Ms. Van Lith ought to shift to special grounds of jurisdiction based on sufficient connection between the defendant and the forum state. In that respect, she proposes jurisdiction at the place where the defendant has a fixed place of business from which he carries out business activities directly related to the claimant’s contractual claim. Absent such a place of business, jurisdiction is to be vested in the courts of the country where the defendant is engaged in substantial business activities in relation to the contract with a limited forum shopping for a claimant in favour of the court of the defendant’s home country. Other general or special grounds for jurisdiction (such as claimant-related connections or property-based connections) are rejected because they do not meet the proposed paradigm of sufficient connection. As to exceptions to international jurisdiction rules as proposed, Ms. Van Lith comes to the conclusion that a general escape provision is to be avoided except for the ‘tra- acting business’ rule where – in accordance with the paradigm proposed – international jurisdiction can be avoided in favour of the defendant’s home court when the dispute is insufficiently connected with the forum making it unfair under the circumstances to expect the defendant to be subjected to the jurisdiction of that court. In this respect, a balanced approach to predictability and flexibility is being proposed.

Available in PDF, EPUB and Kindle. Book excerpt: Zacarias Moussaoui was arrested in the United States in August 2001. He is currently in a federal prison in Virginia, charged with "conspiring with Osama bin Laden and Al-Qaeda to murder thousands of innocent people in New York, Virginia, and Pennsylvania." Moussaoui , who trained to be a pilot in Oklahoma, admits to being a member of Al-Qaeda but denies involvement in the events of September 11. He has opted to defend himself. Written by his brother, Zacarias, My Brother tells the story of Zac’s life from birth to the time in 1996 when he broke contact with his family and became deeply involved with Muslim fundamentalists in London. It is a unique document about what it is to grow up a Muslim in Western Europe today and how an extremist is made. In Zacarias, My Brother, author Abd Samad Moussaoui describes the struggle that young Arab men and their families endure in Europe, seeking an education and equal opportunity, only to find most avenues of assimilation effectively barred to people of color. At the same time, he authoritatively details the techniques of the extremist sects that recruit potential terrorist cadres. Members of the Wahhabi sect have perfected a rhetoric that appeals to the wounded pride of these young Arab men, Moussaoui writes—for example, offering funds to help them complete their education. Moussaoui deplores the route taken by his brother. He is not in any way an apologist for terrorism. Even so, he shows convincingly that normal young men can end up terrorists, and suggests how and why this happens. Moussaoui shows with gripping clarity how Wahhabism distorts true Islamic faith and the threat it poses to Islam. And his book strongly suggests that the best defense against terrorist groups like the Wahhabi sect in the future is anything people can do to end racism.

Available in PDF, EPUB and Kindle. Book excerpt: The essays in this book provide the first comprehensive treatment of the concept of revolution in mathematics. In 1962 an exciting discussion of revolutions in the natural sciences was prompted by the publication of Kuhn's The Structure of Scientific Revolutions. A fascinating but little knownoffshoot of this debate was begun in the USA in the mid-1970s: can the concept of revolutions be applied to mathematics as well as science? Michael Crowe declared that revolutions never occur in mathematics, while Joseph Dauben argued that there have been mathematical revolutions and gave someexamples. The original papers of Crowe, Dauben, and Mehrtens are reprinted in this book, together with additional chapters giving their current views. To this are added new contributions from nine further experts in the history of mathematics who each discuss an important episode and consider whether it was arevolution. This book is an excellent reference work and an ideal course text for both graduate and undergraduate courses in the history and philosophy of science and mathematics.

Available in PDF, EPUB and Kindle. Book excerpt: 'Votes should be weighed, not counted', Nineteenth-century liberals argued. This study analyzes parliamentary suffrage debates in England, France and Germany, showing that liberals throughout Europe used a distinctive political language, 'the discourse of capacity', to limit political participation. This language defined liberals, and they used it to define and limit full citizenship. The rise of consumer culture at the end of the century drove the discourse of capacity from politics, but it survives today in education and the professions.
