Available in PDF, EPUB and Kindle. Book excerpt: Advances in research and development reveal the immense diversity and potential of marine genetic resources. Under international law, no specific regime applies to these complex and paradoxical objects of use. The Law of the Sea Convention sets a framework that is partly inadequate for this new category of resources. The Biodiversity Convention and the Nagoya Protocol only address the genetic resources of national areas. Patents allow their holder to exercise a monopoly on exploiting biotechnological creations to extensive claims, questioning the common nature of biodiversity and related knowledge. They hinder research and the objectives of biodiversity law. The legal and practical rules of physical and functional access vary in geometry. They focus on the valorization of research results, crystallizing conflicts of interest between suppliers and users. Sustainable research and development is essential to the knowledge and protection of marine biodiversity. The qualification of marine genetic resources in common, standard contractual tools, distributed research and development infrastructures, negotiation of an agreement on sustainable use and conservation of biodiversity beyond the limits of national jurisdiction, would To remove these inconsistencies.

Book excerpt: The Exploitation of Marine Genetic Resources in Areas beyond National Jurisdiction by Valérie Wyssbrod begins by identifying the legal regime applicable to these underexploited resources which offer vast potential for the development of new drugs, bioplastics, depolluting products and other innovations. The author then outlines provisions for a new treaty, currently under discussion at the UN and presents alternatives to a new regime including revised legal instruments, the development of soft law and the creation of an applicable ecolabel.

Book excerpt: This Lexicon, aimed at NGOs, lawyers, diplomats and students, follows the same method as the Lexicon of Human Rights - Les définitions des droits de l'homme, published by Martinus Nijhoff Publishers in 2008. Definitions related to the environment are gathered by extracting them from relevant universal scope texts. This ordered grouping of definitions will enlighten the reader about the priorities of the international community regarding environmental law. Definitions are classified in alphabetical order, in separate English and French lists. In each language there is an alphabetical list of common terms with the equivalent second language term in square brackets. The list gives the exact detailed meaning followed by the source of each term. Following this list, a lexicon of the same terms is given under such general themes as "Mammals", "Gas", "Lead". Finally, a list of relevant documents which can be referenced for further information is included.

Book excerpt: The book aims to further the debate on the impacts of fisheries policies in the Indian Ocean Region in order to facilitate a new regional policy direction. A key argument of the volume is that ecologically sustainable and socially just development and management of Indian Ocean fisheries require a paradigm shift in the perceptions and policies of major stakeholders. A central policy challenge is to identify a collective regional interest for fisheries and accordingly the development of integrated management policies that link ecology and society and which incorporate individuals, communities, agencies, states and regimes into a holistic cooperative endeavour. Successful ocean governance therefore requires greater inter-state and inter-agency consultation and cooperation, an improvement in linking national initiatives to local action, increased participation of local government and local communities and the enhancement of local capability. In order to achieve this overall goal requires either the enhancement of existing regional institutions or the creation of a new regional body. Available in PDF, EPUB and Kindle. Book excerpt: How can we simultaneously conserve biodiversity and use its components (genetic resources) to create new medicines and better seeds ? Signed in 1992, at the Eearth Summit in Rrio, the Convention on Biological Diversity answers this question by resorting to intellectual property rights on living material with the objective to create a market for genetic resources. Fifteen years later, we cannot but observe that biodiversity keeps eroding and that the proliferation of intellectual property rights hinders research and innovation on new medicines and seeds. Combining legal, economical and historical approaches, this book explains in simple terms how the Biodiversity Convention came into existence, and how the providing countries and bio-industries (pharmaceutical and seeds industry) are striving to implement it, and why the Convention and its project of a market for genetic resources do not work properly. The book, then, examines new orientations and suggests avenues for solutions. What makes this book different ? It puts the Convention on Biological Diversity back in the wider context of the organization of both innovation and conservation of nature. This approach highlights what is really at stake: • Financing innovation and conservation: what should be the distribution of tasks between the market and public funding ? • Coordinating the agents of conservation and innovation (providing countries, local communities, universities, firms, etc): what should be the distribution of tasks between the market and regulation ?
