Le phénomène est certes ancien. Déjà au XIXe siècle, la chambre criminelle avait dégagé les théories aujourd'hui classiques des droits de la défense et des nullités. Mais depuis quelques décennies, il se développe singulièrement, et pour deux raisons au moins. D'abord les textes de plus en plus complexes et dont la conciliation est de plus en plus malaisée appellent de façon pressante une interprétation qui ne peut provenir que du juge pénal. Ensuite, avec le poids croissant de la Convention européenne des droits de l'Homme, les arrêts de la Cour européenne prennent désormais une importance considérable en ce qu'ils inspirent ceux de notre chambre criminelle. Voilà pourquoi s'impose un ouvrage actualisé sur les grands arrêts de la procédure pénale. Ses auteurs se sont efforcés de retenir les plus importantes décisions de la chambre criminelle et d'ajouter quelques décisions phare de la cour de Strasbourg, soit une bonne soixantaine d'arrêts en tout. Sans doute, certaines décisions qui n'ont pas été retenues auraient pu l'être. Car tout choix est un peu arbitraire. Les auteurs se sont attachés, pour chaque question, à retenir l'arrêt fondamental, qu'il s'agisse du premier ou du plus caractéristique d'une série ou qu'il s'agisse de celui qui renverse une tradition prétorienne.
