A glimpse at the general judicial latitude generally afforded to parodies, satires, caricatures, and pastiches demonstrates the social and cultural value of this particular form of artistic expression. With the advent of technologies and the evolution of copyright legislation, creative endeavours in the form of parody gathered a new youth but became unlawful. While copyright law grants exclusive rights to right-holders, this right is not absolute. Legislation includes specific exceptions, which preclude right-holders from exercising their prerogatives in particular cases which foster creativity and cultural diversity within that society. The parody exception pertains to this ultimate objective by permitting users to reproduce copyright-protected materials for the purpose of parody. To understand the meaning and scope of the parody exception, this book examines and compares five jurisdictions which differ in their protection of parodies: France, Australia, Canada, the US and the United Kingdom. This book is concerned with finding an appropriate balance between the protection awarded to right-holders and the public interest. This is achieved by analysing the parody exception to the economic rights of right-holders, the preservation of moral rights and the interaction of the parody exception with contract law. As parodies constitute an artistic expression protected under the right to freedom of expression, this book also considers the influence of freedom of expression on the interpretation of this specific copyright exception. Furthermore, this book aims at providing guidance on how to resolve conflicts where fundamental rights are in conflict. This is the first book in English to offer an in-depth investigation into the parody exception in copyright law, and comments on industry practices linked to this form of creative endeavours.

La liberté d'expression justifie la courte analyse, la citation, la revue de presse, la parodie, le pastiche et la caricature, ces limitations partageant d'autre part la qualification d'intérêt légitime juridiquement protégé avec l'exception de copie privée. Cette exception doit trouver justification dans la maximisation des utilités retirées par l'auteur et le copiste. Cela suppose de la part des intéressés un changement significatif dans la perception de l'exploitation des oeuvres et leur utilisation par le public, afin de mettre cet intérêt légitime au service de l'optimisation du droit. Telle n'est pas l'approche de la loi du 1er août 2006. Conjuguant sous l'égide d'une nouvelle autorité administrative indépendante la consécration des mesures techniques de protection et le maintien de la copie privée, le nouveau système apparaît comme un régime de transition. Quoiqu'une solution de compromis statique telle que la licence globale ait été heureusement écartée, il est regrettable que des modèles alternatifs novateurs n'aient pas été envisagés. Notamment, les techniques de superdistribution intégrent plus harmonieusement les nouvelles technologies de copie et de diffusion des oeuvres dans l'orbite du droit exclusif.

Au-delà de ces interrogations fondamentales, le colloque s'attache à une analyse plus fouillée de la façon dont l'équilibre des intérêts peut être recherché dans trois séries d'exceptions : l'exception de copie privée, qui mérite un examen spécial compte tenu de son importance pratique et de l'incidence de l'arrêt Padawan du 21 octobre 2010, les exceptions à des fins d'information d'actualité, dont les médias sont prompts à revendiquer l'extension, et les exceptions à des fins d'enseignement et de recherche, souvent présentées comme essentielles pour assurer le développement de ce que la Commission européenne appelle la "société de la connaissance".

La première partie de cette thèse est consacrée à cette balance des intérêts législative, et à l'écart entre ce qu'elle devrait être, idéalement, et ce que les derniers travaux législatifs laissent paraître de sa réalité. Le second temps de l'étude se concentre sur la mise en œuvre des exceptions. Leur application classique, d'abord, qui fait appel à la fonction d'interprétation des textes par le juge dans ce qu'elle a de plus traditionnel. Mais également, ensuite, une nouvelle forme de mise en œuvre, qui a fait irruption sous l'ère numérique : la régulation des exceptions.
