Toutefois, la seule consécration légale des droits exclusifs, individuels et opposables à tous au profit de l’auteur ne semble pas être suffisante pour atteindre l’objectif poursuivi. Conscient de ce déséquilibre et afin d’améliorer l’effectivité des droits exclusifs de l’auteur, le législateur a adopté un ensemble de règles complémentaires protectrices ayant pour objet de régir les contrats le liant avec son exploitant. En encadrant juridiquement la puissance du partenaire économique de l’auteur, le législateur s’est immiscé dans cette convention particulière afin de protéger le créateur de l’œuvre contre les velléités parfois exorbitantes de l’exploitant de celle-ci. Cette étude a pour objet d’examiner les mécanismes contractuels destinés à établir l’équilibre souhaité entre les parties, tels qu’ils sont prévus par les législateurs allemand, belge, français et hellénique. Dans un premier temps, il paraît évidemment indispensable d’examiner l’efficacité de l’intervention législative au stade de la formation du contrat d’exploitation du droit d’auteur. Sous une apparente convergence de principe dans la reconnaissance des règles protectrices en faveur de l’auteur, pendant la formation des contrats, les trois systèmes étudiés diffèrent sur certains points. Mais l’intervention législative est également essentielle au stade de l’exécution du contrat d’exploitation. Dans ce contexte, la détermination d’une rémunération adéquate au profit de l’auteur reste au centre des préoccupations. La directive européenne 2001/29/CE sur l’harmonisation du droit d’auteur et des droits voisins a également pris en considération l’importance de cette question. D’une grande honnêteté intellectuelle dans la présentation des options législatives comme des thèses doctrinales, sachant de théoriser mais aussi marquée d’un esprit réaliste remarquable, c’est bien un travail riche et approfondi qui va servir au monde spécialisé en propriété littéraire et artistique.
