Désormais, au moment où de nombreux auteurs affirmaient que « le concept de régulation n’était pas juridique », la crise financière qui s’est développée depuis l’été 2007 aux États-Unis a marqué un retour du balancier avec une importance accrue accordée aux questions de régulation. Si la dimension européenne et internationale des affaires s’est accompagnée d’un changement de la conjoncture économique, les secousses financières cataclysmiques survenues outre-Atlantique ont entraîné un ralentissement de l’économie mondiale, mettant en exergue l’insuffisance de la régulation dans un système bancaire et financier globalisé. Face à de nouveaux acteurs, tels que la Chine, il appartient désormais à l’Union européenne d’avoir une position claire et précise sur le niveau de la régulation pour corriger et prévenir le marché. Dans ce marché qui connaît une fusion entre les activités financières - les banques proposant des produits d’assurance et les compagnies d’assurance proposant des services bancaires et des produits financiers complets - l’organisation du cadre institutionnel des autorités de régulation financière européenne se situe au centre de notre débat : Quelle est l’autorité de régulation compétente pour contrôler ces activités et réorganiser le mécanisme de la régulation dans le domaine bancaire et financier ? Faut-il confier à une seule institution la régulation prudentielle des intermédiaires et celle du marché ou faut-il, au contraire, l’organiser par métier ? Existe-t-il une architecture institutionnelle permettant de concevoir une structure optimale de la régulation financière ?
