Book excerpt: La huelga ha sido y es una realidad con un carácter siempre bifronte y en ocasiones poliédrico. Por un lado constituye un derecho fundamental de los trabajadores, acaso uno de los últimos derechos fundamentales en reconocerse como tal, mientras que, por otra parte, es también la máxima expresión del fracaso de las relaciones laborales así como de los sistemas negociados para la solución de los conflictos que de éstas se derivan. Acaso el carácter fuertemente polémico que caracteriza al hecho de la huelga tenga incidencia en la propia regulación del derecho a la huelga, haciendo de éste una de la áreas sujetas a permanente debate en todo momento y en especial en las situaciones de conflictividad agravada. Y además en el debate se mezclan, al lado de los temas propios de la relación laboral otros elementos de distinto orden pero no menor importancia, ya sean los derechos de los terceros, clientes o ciudadanos en general, o la viabilidad económica de la empresa, o el mantenimiento de la posibilidad productiva de la empresa en el futuro, o el protagonismo que deben tener los poderes públicos en estas situaciones, por poner algunos ejemplos relevantes. Pocas materias pues más precisadas de análisis con perspectiva histórica que el derecho de huelga, un análisis llamativamente escaso para la importancia que sin duda tiene y cuya ausencia viene afortunadamente a cubrirse ahora con el presente libro de «Legislación histórica de huelga» que sin duda será del máximo interés para los operadores jurídicos relacionados con el derecho laboral y también para quienes, desde la mera curiosidad histórica, deseen tener un conocimiento cabal de las distintas perspectivas desde las que se afrentó el problema a lo largo de los años. Todo ello sin olvidar, y no es este un dato menor, que la propia regulación vigente del derecho de huelga en España puede calificarse, dada su antigüedad, como de histórica, pues no en vano se trata de la columna más antigua de todo el andamiaje que sostiene el permanentemente renovado edificio del Derecho Laboral español.
