Available in PDF, EPUB and Kindle. Book excerpt: An essential reference for practitioners, emphasizing how legal concepts affect the process of bringing architectural vision to reality. Law for Architects: What You Need to Know guides design professionals through the daunting landscape where design and construction meet the legal system. It provides an introduction—written in clear, reader-friendly language—to issues that arise at every stage in the practice of architecture. For architects starting or building their own practice: Why do I need a written agreement with my clients? Why do I need insurance? How do I organize my firm? For seasoned architects considering retirement: How do I transfer ownership in my company? How can I benefit from the good will I helped to build? For students who want to learn more about the practicalities of starting out: Why is it important to have a license? Isn’t it enough to have a degree in architecture? What are my rights as an employee? It also addresses the perennial questions that concern architects: How do I protect myself from being sued? How do I protect my intellectual property rights in my work? and much more. Law for Architects identifies the legal issues that lurk in every corner of your design practice and helps you figure out what questions you need to ask.

Book excerpt: The primary focus of this text is to provide a bridge for students between the academic world and the real world. This bridge is built through an understanding of what is law, how law is created, how law affects almost every activity of human conduct, and how legal institutions operate. Intended mainly for architectural and engineering students, but increasingly for those in business schools and law schools, this text features a clear, concise, and jargon-free presentation. It probes beneath the surface of legal rules and uncovers why these rules developed as they did, outlines arguments for and against these rules, and examines how they work in practice. Updated with the most recent developments in the legal aspects of architectural, engineering, and the construction processes, this text is also a valuable reference for practitioners that has been cited in over twenty-five court decisions. Available in PDF, EPUB and Kindle. Book excerpt: Architect's Legal Handbook: The Law for Architects, Fifth Edition is a collection of papers including those on International Work by Architects, on European community Law affecting Architects, and the Architects' Professional Indemnity Insurance. This collection is a comprehensive guideline to laws in England, Scotland, and the European community. This handbook seeks to make architects more aware of where possible legal pitfalls may lurk. Coverage is updated to include changes in English Law, Scottish Law, English Law of Contract, the Law of Tort, Architect's Appointment and Collateral Warranties, Architects' Liability, English and Scottish Land Laws, and the Standard Building Contracts in England. The origins and sources of the laws and the basic principles are explained, which guide the reader into how these are applied in the architects' relations with their clients and clients; contractors. A wider discussion is given on the topic of collateral warranties, incorporation options, and legal organizations such as partnerships and limited companies. Upon the formation of the European Community, institutions and treatises have arisen, so a review of technical harmonization and standards, right of establishment and freedom to provide services, product liability, and consumer protection is provided in order. The international workplace for British architects is also discussed, covering most countries in Europe. This collection of papers will prove useful for architects and engineers, especially those who want to put up their own architectural firms. The book can be likewise an informative source for architectural students, lawyers, and professors in business and commercial law.

Book excerpt: Excerpt from Engineering and Architectural Jurisprudence: A Presentation of the Law of Construction for Engineers, Architects, Contractors, Builders, Public Officers, and Attorneys at Law The author has refrained from giving a full contract form for general use in construction work, and he would warn his readers of the mischief that often results from the adoption of such forms for special cases. The adoption of a single clause, without the careful consideration that the ques tions presented deserve, is discouraged. Much trouble and litigation are the result of adopting loosely or carelessly prepared contracts for construction work. Available in PDF, EPUB and Kindle. Book excerpt: Architect and Engineer Liability: Claims Against Design Professionals, Fifth Edition, details all relevant topics relating to liability claims: risk management, alternative dispute resolution, trial conduct, handling shop drawings, insurance and surety, and more. Prepared for design and construction professionals and their attorneys, this comprehensive, up-to-date resource is written by eminent authorities in the field and provides straightforward answers to all your legal questions, as well as examples of the valuable lessons learned by leading design and construction experts. The Fifth Edition adds significant new and revised material on a number of critical topics, as well as expanded discussion and analyses of the latest court decisions, trends, and issues in the rapidly evolving area of construction law, including the following: Explanation for the American Institute of Architect's (AIA's new and revised forms: Construction Manager as Adviser (B132(TM)-2019); Construction Manager as Constructor (B133(TM)-2019); and Standard Form Multi-Party Agreement for Integrated Project Delivery (AIA C191-2019). Which of an architect's commercial general liability policies apply is dependent upon whether there is damage during the respective policy period. And if there is damage over several policy periods, the issue becomes whether the limits and the self-insured retentions/deductibles "stack." Whether an engineer was protected by the application of the economic loss doctrine can be determined by whether the owner's damage claims were economic losses. The New Hampshire Supreme Court in 2019 held that indemnity and contribution claims against a design professional could be barred by the New Hampshire statute of repose as purely economic losses. The 2019 AIA updates to the Construction Manager as Constructor (CMc) documents include a new standard of care that requires the construction manager to "exercise reasonable care in performing its Preconstruction Services"; and contain insurance requirements for the CMc during the preconstruction phase that match the insurance requirements for the architect. Effective August 1, 2019, a North Carolina law provides critical protections for design professionals when faced with the question of whether they owed a duty to defend the owner of a project. A New York City mayor's discretionary conduct in refusing to take the steps necessary to authorize a construction project (i.e., inaction) was shielded by legislative immunity. A provision of the standard form A201 General Conditions incorporated into a contract further defined the term "architect" to include the authorized representatives of the listed architect in the contract which permitted a principal, as a representative of the architectural firm, among those persons able to demand arbitration under the terms of the contract. Under Indiana law, construction managers owe a duty for job-site employee safety in two circumstances: when the construction manager has contractually assumed a duty for job-site safety or when the construction manager voluntarily assumed a duty for job-site safety.

Book excerpt: Excerpt from The Law of Architecture and Building: A Consideration of the Mutual Rights, Duties and Liabilities of Architect Owner and Contractor, With Appendices and Forms Conscious violations of the building law by architects are not frequent, yet they are by no means uncommon, and are often forced by the poorly written and untechnical statutes of many Of our States.
