Book excerpt: The "Menu for Justice" project - funded with support from the European Commission - is the first European project that takes seriously the issue of how a new generation of Europeans should be trained in law and legal matters, as well as how experts in law and the judicial process can develop new skills and competences to effectively face the challenges of a common judicial space. The project takes up a major issue in contemporary judicial politics: to what extent and by which means can legally relevant expertise be supported to ensure an efficient, effective, and legitimate judicial system? This is not only a matter of policies and of the organization of judicial administrations, it is also a matter of how lawyers - and for more specific functions, judges - are trained considering the current, rapidly changing, societal circumstances. This book is a project report of "Menu for Justice." By devoting three years to the joint progress among 50 partners in Europe, the project assesses the key gaps in legal and judicial education in all European countries at all stages of education - from undergraduate, graduate, and PhD programs in universities to vocational training of lawyers and judges. By examining the "state of the art" of education for law students, lawyers, and judges in Europe, the "Menu for Justice" project offers vital information to policy makers considering the development of an innovative curriculum studiorum in judicial studies. It provides European institutions and the public with basic guidelines for monitoring the way legal and judicial training are changing in Europe. [Subject: Legal Education, European Law]

However, this influence has not been standard. This volume seeks to improve our understanding of how networks function, as well as the extent they matter in the governance of a constitutional democracy. The authors examine the judicial function of networks, the way they cross the legal and territorial borders that confine the jurisdiction of the domestic institutions, and whether or not they are independent of the capacity and the leadership of their members. A highly salient issue in contemporary law and politics, judicial networks are now qualified actors of governance. With the aim to understand how, to what extent, and with what consequences networks interact with hierarchical institutions that still exist within the States, this book is essential reading for legal experts, policy makers engaged in promoting the rule of law, members of the judicial networks in the EU and extra EU countries, as well as academics and students.

Available in PDF, EPUB and Kindle. Book excerpt: This book discusses the opportunities and challenges facing legal education in the era of globalization. It identifies the knowledge and skills that law students will require in order to prepare for the practice of tomorrow, and explores pedagogical shifts legal education needs to make inside and outside of the classroom. With contributions from leading experts on legal education from various jurisdictions across the globe, the work combines theoretical depth with practical insights. Seeking to understand the changing landscape of legal education in the era of globalization, the contributions find that law schools can, and must, adopt educational strategies that at least present students with different understandings of what studying and practicing law is meant to be about. They find that law schools need to offer their students choices, a vision of practice that is not driven entirely by the demands of the marketplace or the needs of major international law firms. Bridging the gap between theory and practice, this book makes a significant contribution to the impact of globalization on legal education, and how students and law schools need to adapt for the future. It will be of great interest to academics and students of comparative legal studies and legal education, as well as policy-makers and practitioners.

Book excerpt: EU law only serves citizens if properly implemented. Training of justice professionals on EU law is essential to ensure the correct and coherent application of EU law across the EU, to improve mutual trust and to foster a common judicial European culture, including on the rule of law. This report measures the participation of legal practitioners in judicial training on EU law in the EU. At the same time, it supports the overall strategy on European judicial training by keeping the topic high on the political agenda. The report complements the Evaluation of the European judicial training strategy published in October 2019 and shows excellent results in terms of participation. In 2018, more than 190 000 legal practitioners took part in training on EU law or the law of another Member State. The yearly number of participants increased by 148 % between 2011 and 2018. In total, more than 1 million legal practitioners attended training on EU law since 2011. There has been an ever-increasing growth in the number of participants and training activities since 2011. The strategy led to an almost doubling of EU funds available for training legal practitioners and significant improvements in the capacity of networks and training providers such as the European Judicial Training Network (EJTN). The strategy's lasting effects are visible in improved knowledge of EU law, strengthened mutual trust and an increased level of cooperation among justice professionals in the EU Member States. Training providers and networks also consolidated their capacity for delivering training on EU law. In 2018, judicial training continued to respond to new training needs in particular by addressing rule of law challenges. A landmark-training programme for justice professionals on key issues of fundamental rights and rule of law was implemented starting from 2018, as part of the European Commission's strategy for the effective implementation of the EU Charter of Fundamental Rights. The aim was the strengthening a rule of law culture, by increasing the knowledge of the rule of law standards. The positive results achieved so far are an encouragement for going further and taking up new challenges. Both the evaluation and the current report confirm the need to reach better some categories of justice professionals, notably lawyers, court staff, and to further focus training on topics such as the rule of law and fundamental rights.

Book excerpt: European legal teaching - historically formalistic, doctrinal, hierarchical, and passive - is coming under increasing pressure to reimagine itself as pragmatic, policy-aware, and action-oriented. Out of this context, a bottom-up movement of university law clinics appears to be emerging in Europe. Although intellectually indebted to the US model, the European variant reflects legal education and practice in Europe, specifically the multi-layered and multi-genetic legal landscape resulting from the Europeanization and internationalization of national legal systems, the globalization of European legal markets, and the growing demand for civic engagement in view of increasingly powerful supra-national institutions. Through the prism of clinical legal education, Reinventing Legal Education is the first attempt to gather scholarly and systematic reflections on the developments taking place in European legal teaching and practice. This groundbreaking book should be read by anyone interested in how clinical legal education is reinventing legal education in Europe.

Book excerpt: This is the ninth report on training for justice professionals (judges, prosecutors, court staff, lawyers, notaries and bailiffs) on EU law or the national law of another Member State. It is based on the results of a questionnaire sent in 2020 to Member States' authorities, European networks of legal professionals and their national members, and the main EU-level providers of training for legal practitioners. For the last time, this report charts the progress towards the target set by the Commission (in its 2011 Communication 'Building trust in EU-wide justice - a new dimension to judicial training') of ensuring that half (around 800 000) of all justice professionals in the EU are trained on EU law or the law of another Member State by 2020. On 2 December 2020, together with this report, the Commission adopted a new Communication 'Ensuring justice in the EU - a European judicial training strategy for 2021-2024' with new qualitative and quantitative objectives. This report includes for the last time the graph on European judicial training's progression for the EU28. All other data and graphs relate to the EU27 as no UK stakeholder provided data for 2019.

Book excerpt: This volume focuses on a highly challenging aspect of all European democracies, namely the issue of combining guarantees of judicial independence and mechanisms of judicial accountability. It does so by filling the gap in European scholarship between the two policy sectors of enlargement and judicial cooperation and by taking full stock of an interdisciplinary literature, spanning from comparative politics, socio-legal studies and European studies. Judicial Accountabilities in New Europe presents an insightful account of the judicial reforms adopted by new member States to embed the principle of the rule of law in their democratic institutions, along with the guidelines of quality of justice promoted by European institutions in all member States.

Book excerpt: This is the seventh report on training for legal practitioners (judges, prosecutors, court staff, bailiffs, lawyers and notaries) on EU law or the national law of another Member State. It is based on the results of a questionnaire sent in 2018 to Member States' authorities, European networks of legal professionals and their national members, and the main EU-level providers of training for legal practitioners in 2017. It charts progress towards the target set by the Commission (in its 2011 Communication Building trust in EU-wide justice: a new dimension to European judicial training2) of ensuring that half (around 800 000) of all legal practitioners in the EU are trained on EU law or the law of another Member State by 2020; this is equivalent to an average of 5 % (80 000) of all practitioners per year. The objective was backed by the Justice and Home Affairs Council in 2011 and again in 2014, when the Member States underlined the importance of training for legal practitioners. The European Parliament has also been a constant supporter of European judicial training, as expressed in its 14 March 2012 resolution on judicial training.

Book excerpt: This collection is the multifaceted result of an effort to learn from those who have been educated in an American law school and who then returned to their home countries to apply the lessons of that experience in nations experiencing social, economic, governmental, and legal transition. Written by an international group of scholars and practitioners, this work provides a unique insight into the ways in which legal education impacts the legal system in the recipient’s home country, addressing such topics as efforts to influence the current style of legal education in a country and the resistance faced from entrenched senior faculty and the use of U.S. legal education methods in government and private legal practice. This book will be of significant interest not only to legal educators in the United States and internationally, and to administrators of legal education policy and reform, but also to scholars seeking a more in-depth understanding of the connections between legal education and socio-political change.

Book excerpt: This two-day conference in the French city of Bordeaux discussed the initial training of justice professionals, in particular magistrates and lawyers, the respect for the rule of law in the EU, and their links. Jointly hosted by the French Presidency of the Council of the EU, the École Nationale de la Magistrature (ENM) and the European Commission, the conference brought together over 150 national and European level training providers and associations in charge of post-university training for judges, prosecutors and lawyers, from all 27 EU Member States and the Western Balkans, alongside trainees from those professions and an online audience. As such it aimed to support and to contribute to the priorities of the European judicial training strategy for 2021-2024.
