Available in PDF, EPUB and Kindle. Book excerpt: Domestic violence accounts for approximately one-fifth of all violent crime in the United States and is among the most difficult issues confronting professionals in the legal and criminal justice systems. In this volume, Elizabeth Britt argues that learning embodied advocacy—a practice that results from an expanded understanding of expertise based on lived experience—and adopting it in legal settings can directly and tangibly help victims of abuse. Focusing on clinical legal education at the Domestic Violence Institute at the Northeastern University School of Law, Britt takes a case-study approach to illuminate how challenging the context, aims, and forms of advocacy traditionally embraced in the U.S. legal system produces better support for victims of domestic violence. She analyzes a wide range of materials and practices, including the pedagogy of law school training programs, interviews with advocates, and narratives written by students in the emergency department, and looks closely at the forms of rhetorical education through which students assimilate advocacy practices. By examining how students learn to listen actively to clients and to recognize that clients have the right and ability to make decisions for themselves, Britt shows that rhetorical education can succeed in producing legal professionals with the inclination and capacity to engage others whose values and experiences diverge from their own. By investigating the deep relationship between legal education and rhetorical education, Reimagining Advocacy calls for conversations and action that will improve advocacy for others, especially for victims of domestic violence seeking assistance from legal professionals.

Available in PDF, EPUB and Kindle. Book excerpt: European legal teaching - historically formalistic, doctrinal, hierarchical, and passive - is coming under increasing pressure to reimagine itself as pragmatic, policy-aware, and action-oriented. Out of this context, a bottom-up movement of university law clinics appears to be emerging in Europe. Although intellectually indebted to the US model, the European variant reflects legal education and practice in Europe, specifically the multi-layered and multi-genetic legal landscape resulting from the Europeanization and internationalization of national legal systems, the globalization of European legal markets, and the growing demand for civic engagement in view of increasingly powerful supra-national institutions. Through the prism of clinical legal education, Reinventing Legal Education is the first attempt to gather scholarly and systematic reflections on the developments taking place in European legal teaching and practice. This groundbreaking book should be read by anyone interested in how clinical legal education is reinventing legal education in Europe.

Available in PDF, EPUB and Kindle. Book excerpt: This book discusses legal services clinics and various other access-to-justice initiatives that are established to protect and represent the rights and interests of children and youth in several countries across the globe. These could include legal services or access-to-justice clinics run by government or universities or community. The book has contributions from academicians, lawyers, researchers and legal professionals from several counties including India, UK, USA, Brazil, Australia, Indonesia, Poland, and Spain, which discuss how they represent children and youth in their countries. The book looks at how these access-to-justice initiatives currently provide assistance, what are the child friendly justice procedures they use, and best practices that can be replicable in other jurisdictions. The chapters contain findings of field research studies, some case studies, and models related to these topics. There are recommendations on ways to strengthen access-to-justice and legal services for empowering children and youth. The main goal is to create a resource for readers who want to expand child advocacy opportunities in their own universities and communities. The reader may also learn how to conduct legislative advocacy and case law advocacy to improve laws in other jurisdictions; and take-away best and replicable initiatives. The practices could be adaptable by other clinics and countries. The book will be useful to child rights advocates and defenders, students of law, legal researchers, civil society organizations, legal services authorities, legal aid institutions, educational institutions, school authorities, juvenile justice authorities, clinical legal educators, justice educators, justice practitioners and law and policy makers.

Book excerpt: As lawyers, legal scholars, and academics throughout the social sciences debate the future of legal work and the legal profession itself, they turn their attention inevitably to the rise of the franchise law firms. Founded in response to the changing market for legal services, franchise law firms have grown dramatically in recent years, but at what cost to clients and lawyers alike? This book focuses on how professional organizations (and the related work experience) are influenced by economics and the way various firms have excelled by mass producing a basic menu of services—by placing their offices at strategic locations, hiring inexperienced new law school graduates, and using television and other hard-sell means to attract clients. Van Hoy's impeccable sociological research, presented in a clear, readable, anecdotal style, will be fascinating and useful reading, not only for members of the legal profession and their academic colleagues, but also for aspiring lawyers and their future clients. Van Hoy shows that franchise law firms are a competitive innovation in the market for personal legal services—an innovation that has served to standardize lawyers' work and to dehumanize lawyers themselves. Precisely because the work of attorneys can be standardized and mass produced, a finding that may astonish some and dismay others, attorneys may be even more alienated from their chosen profession than their clients suspect. Van Hoy analyzes these matters and captures the broader context in which prepackaged firms operate; indeed, he compares franchised attorneys to lawyers in different types of firms who are also competing for the same business. Van Hoy is convinced that many attorneys are not only alienated but are ripe for unionization. He shows that collegiality no longer insulates attorneys from the pressures and dissatisfactions of the outside world, a research finding that in itself may seriously challenge prevailing viewpoints and shake confidence in the belief that legal work is not just a profession, but also a calling.

Available in PDF, EPUB and Kindle. Book excerpt: Sociology of Crime, Law and Deviance" is an annual series of volumes that publishes scholarly work in criminology and criminal justice studies, sociology of law, and the sociology of deviance and social control. These are very broad topics, and the series reflects this breadth. The series includes theoretical contributions, critical reviews of literature, empirical research, and methodological innovations. The series especially showcases "big picture" pieces that review and critically reconceptualize what is known and what remains to be understood about broad directions of research and theorizing about crime, justice, law, deviance, and social control. In addition, the series showcases a diversity of methodological approaches. "Volume 2" demonstrates such methodological diversity by presenting quantitative studies, ethnographies and discourse analyses. Through an application of these methodologies, the authors examine sanctions, crime and fear and legal and social control organizations and processes. The volume concludes with four chapters contributing to theory development.

Available in PDF, EPUB and Kindle. Book excerpt: We live in a “law-thick” world. For individuals and organizations in both the public and private sectors, navigating the large number of complex laws, rules, institutions, and procedures that pervade American life is virtually impossible without some assistance. Some argue that "there are too many lawyers." Others argue that the unmet need for legal services is so high that it constitutes a human rights crisis. This book exposes why it is easy to access legal services for some, while it is virtually impossible for others, and why some lawyers have successful careers, but others cannot. This book argues that the problems plaguing legal services in the US can be only be addressed by a radical overhaul of the rules that govern how legal services may be delivered, as well as radical changes to who exercises the power to make those rules. Through interviews with those with experience with alternative legal service providers, this book exposes the formidable obstacles that exist along the path to those changes, as well as the opportunities that await.
