Available in PDF, EPUB and Kindle. Book excerpt: The five versions of the comprehensive settlement plan for Cyprus, which UN Secretary-General Annan tabled between 2002 and 2004, raised a variety of international law and European law questions. This book contains the first systematic analysis of the Annan plan, thereby providing an overview of the legal aspects of the Cyprus problem. It also discusses how the plan was intended to be accommodated in the European legal order. Did it comply with the fundamental principle of democracy, rule of law and human rights? Would a united Cyprus have been able to speak with one voice and to implement EU law properly? The Author, who has worked both for the European Commission and for the UN Special Advisor on Cyprus, presents a precise account of facts and thorough legal assessments. He also tackles current legal problems arising out of Cyprus' membership in the EU and the suspension of the "acquis communautaire" in the northern part of Cyprus. He finally analyses how the question of recognition affects the relations between Cyprus and Turkey. The book is an ideal choice for practitioners and researchers because it combines first hand information on the most recent developments on Cyprus with legal evaluations from an international official trained in international and European law.

Available in PDF, EPUB and Kindle. Book excerpt: Examines the effects of culturally specific interpretations of refugeehood with an ethnographic focus on Cyprus. Being a “refugee” is not simply a matter of law, determination procedures, or the act of flight. It is an ontological condition, structured by the politics of law, affect, and territory. Refugeehood and the Postconflict Subject explores the variable facets of refugeehood, their interconnections, and their intended and unintended consequences. Grounded on more than a decade of research on the island of Cyprus, Olga Maya Demetriou considers how different groups of “refugees” coexist and how this coexistence invites reinterpretations of the law and its politics. The long-standing political conflict in Cyprus produced not only the paradigmatic, formally recognized “refugee” but also other groups of displaced persons not so categorized. By examining the people and circumstances, Demetriou reveals the tensions and contestations within international refugee regimes and argues that any reinterpretation that accounts for these tensions also needs to recognize that these “minor” losses are not incidental to refugeehood but an intrinsic part of the wider issues. “This book offers a number of important insights with respect to refugees and refugeehood. Through the notion of ‘minor’ losses, rather than the conventional focus on ‘big’ losses, the author argues that refugees do not move from conflict to safety but from one conflict into another, or rather into a complexity of conflicting and conflictual situations and circumstances. The idea that ‘minor’ losses are not incidental to refugeehood but an intrinsic part of the wider issues at play is an important insight.” — Leonie Ansems de Vries, author of Re-Imagining a Politics of Life: From Governance of Order to Politics of Movement

Book excerpt: This book, first published in 1978, examines the local and international aspects of the struggle for Greek union with Cyprus – Enosis. The revolt against the British colonial power was a struggle in which guerrilla warfare, political action and international diplomacy were integrated to bring about union with Greece under the camouflaged objectives of self-determination and anti-colonialism. This book traces the origins of the dispute from the Greek War of Independence of 1821 and then deals in depth with the revolt and its international repercussions up to Independence in 1960 and the Turkish military intervention of 1974.

Book excerpt: The contributions collected in the present book go beyond refugee law in its traditional sense - largely centred on questions of durable asylum and the plight of only a small tranche of the asylum-seeking population - in situating refugee law within the broader international legal system. The refugee problem is thus seen as a prism through which a host of exploding issues confront traditional international law and international relations: creation and dissolution of states, state responsibility, human rights, international jurisdiction and the United Nations mandate. These theoretical problems and their legal incidence on the refugee condition are debated against the background of UNHCR field operations in Former Yugoslavia, Africa and Eastern Europe. The contributions were originally presented at a Colloquium held in May 1994, organised by the Graduate Institute of International Studies in collaboration with the Office of the United Nations High Commissioner for Refugees. Refugee law experts, members of the UN International Law Commission and practitioners were brought together in a dialogue between scholars and practitioners on a major and exponentially growing international problem.

Book excerpt: This book focuses on sovereignty referendums, which have been used throughout different historical periods of democratization, decolonization, devolution, secession and state creation. Referendums on questions of sovereignty and self-determination have been a significant element of the international political and legal landscape since the French Revolution, and have been a central element in the resolution of territorial issues from the referendum in Avignon in 1791 until today. More recent examples include Quebec, East Timor, New Caledonia, Puerto Rico and South Sudan. The global aim of this book is to achieve a better empirical and legal understanding of sovereignty referendums and related problems in international and national law and politics. Accordingly, it presents readers a comprehensive study of sovereignty referendums from the perspectives of both international and constitutional law.

Available in PDF, EPUB and Kindle. Book excerpt: Refugee law is going through momentous times, as dictatorships tumble, revolutions simmer and the 'Arab Awakening' gives way to the spread of terror from Syria to the Sahel in Africa. This compilation of topical chapters, by some of the leading scholars in the field, covers major themes of rights, security, the UNHCR, international humanitarianism and state interests and sets out to map new contours. The concerns over our security are replacing humanitarian concerns over the plight of others. Securitization, exclusion and the internal relocation of genuine refugees are now the favoured polices. Yet, while central idioms of protection, persecution and non-refoulement have changed, there are also new demands on refugee law. The contributors to this book ask whether there are new spheres of protection emerging, for which refugee law must find a clear space, such as the protection of child refugees, trafficked persons, gender-related asylum and conscientious objectors to military service. This timely and valuable book shows that in these uncertain times, refugee law still has an exciting and challenging future ahead. Contemporary Issues in Refugee Law will appeal to academics, researchers, students and practitioners.

Available in PDF, EPUB and Kindle. Book excerpt: The island of Cyprus has been the scene of one of the most tragic conflicts in post-war Europe. A country with a long and rich tradition and much to contribute to all of the cultures of the Mediterranean, Cyprus has been torn apart almost since the day of its independence. Since 197, more than a third of the island has been occupied by Turkey. Attempts to find a peaceful solution to the conflict has come and gone but the status quo, branded as unacceptable by the United Nations, has remained. Why this is so has already been the subject of many studies. Few, however, have analysed in any detail the position of Cyprus in international law. Yet an understanding of how the rule of law in international society applies to Cyprus is essential to a proper understanding of the Cyprus question. In his new book, Dr Chrysostomides offers just such an analysis, examining with great care the constitutional history of the Republic of Cyprus, the legal principles applicable to the Turkish invasion of 10974 and subsequent occupation and the substantial body of case law and State practice regarding Cyprus since that date. He discusses the competing legal arguments concerning the application of the Republic of Cyprus to join the European Union, the controversial decisions of the European Court and commission of Human Rights, and the debates regarding the status of the occupied northern part of Cyprus. His conclusion is that the Republic of Cyprus has had a continuous existence as a State – and as the only State on the island of Cyprus – since 1960, notwithstanding all of the violations of international law to which it has been subjected. From the Foreword by Christopher Greenwood, QC
