Available in PDF, EPUB and Kindle. Book excerpt: In Historical Title, Self-Determination and the Kashmir Question Fozia Nazir Lone offers a critical re-examination of the Kashmir question. Through an interdisciplinary approach and international law perspective, she analyses political practices and the substantive international law on the restoration of historical title and self-determination. The book analytically examines whether Kashmir was a State at any point in history; the effect of the 1947 occupation by India/Pakistan; the international law implications of the constitutional incorporation of this territory and the ongoing human rights violations; whether Kashmiris are entitled to restore their historical title through the exercise of self-determination; and whether the Kashmir question could be resolved with the formation of international strategic alliance to curb danger of spreading terrorism in Kashmir.

Book excerpt: This book provides analysis of the legal status of territories of the former Princely State of Jammu and Kashmir, considering potential opportunities for Kashmir conflict resolution. Containing a detailed survey of relevant legislation and international documents, chapters throughout this book investigate the attempts and failures of Kashmir conflict resolution, holding up factors which could enable more peaceful relations between India and Pakistan with inclusion of the inhabitants of the erstwhile Princely State of Jammu and Kashmir. The book goes further than outlining how India and Pakistan determine the legal status of their portions of Kashmir by demonstrating the complexity of legal arrangements and why this protracted conflict is so difficult to resolve. As the Kashmir conflict is not only about territory and irredentism, themes such as cultural and national identity, power procurement, territorial security, communal rivalry, religious radicalisation, economic factors, and social issues are all taken into consideration. Law and Conflict Resolution in Kashmir will appeal to students and scholars of peace and conflict studies, international relations, international law studies, and South Asian studies. Available in PDF, EPUB and Kindle. Book excerpt: Even after 73 years of division of the British India, still there is confusion and controversy on legal status of the former Princely State of Jammu and Kashmir. In light of legal documents, I have endeavoured to establish the exact legal position of Jammu and Kashmir. Apart from that the UN Security Council Resolutions on Jammu and Kashmir dispute are analysed; and why they could not be implemented. Which country refused to implement them or created hurdles. After the Simla Agreement and the Lahore Declaration, can these Resolutions play any role in resolution of the dispute. Also, I have analysed Article 370 and 35A of the Indian constitution, and how India disregarded the pledges made to the people of Jammu and Kashmir; and unilaterally changed the status of Jammu and Kashmir. In addition, I have analysed the role of Pakistan, and how they betrayed people of Jammu and Kashmir to satisfy their imperial agenda. Furthermore, how Pakistan is promoting extremism, terrorism, intolerance and religious hatred in Jammu and Kashmir; and how it is hurting people of Jammu and Kashmir on both sides of the divide. Besides that, I have analysed the impact of these changes on the people of Jammu and Kashmir, and how they have responded. What people of Jammu and Kashmir should do when they are forcibly divided, and when their motherland is under control of three nuclear countries, namely India, Pakistan and China.

Book excerpt: This book presents a study of the international dimensions of the Kashmir dispute between India and Pakistan from before its outbreak in October 1947 until the Tashkent Summit in January 1966. By focusing on Kashmir’s under-researched transnational dimensions, it represents a different approach to this intractable territorial conflict. Concentrating on the global context(s) in which the dispute unfolded, it argues that the dispute’s evolution was determined by international concerns that existed from before and went beyond the Indian subcontinent. Based on new and diverse official and personal papers across four countries, the book foregrounds the Kashmir dispute in a twin setting of Decolonisation and the Cold War, and investigates the international understanding around it within the imperatives of these two processes. In doing so, it traces Kashmir’s journey from being a residual irritant of the British Indian Empire, to becoming a Commonwealth embarrassment and its eventual metamorphosis into a security concern in the Cold War climate(s). A princely state of exceptional geo-strategic location, complex religious composition and unique significance in the context of Indian and Pakistani notions of nation and statehood, Kashmir also complicated their relations with Britain, the United States, Soviet Union, China, the Commonwealth countries and the Afro-Arab-Asian world. This book is of interest to scholars in the field of Asian History, Cold War History, Decolonisation and South Asian Studies.

Available in PDF, EPUB and Kindle. Book excerpt: This book uses an innovative people-centered approach to the Kashmir problem to shed new light on why postcolonial partitions remain unfinished and why the wounds of postcolonial nation-state formation in South Asia continue to fester. "Kashmir" is viewed as a metaphor for the permanent internal wars of partition that mark the South Asian experience. Chapters sensitively bring Kashmiri voices to the fore to examine Kashmir in the national discourses of India and Pakistan, resistance in the Kashmiri imagination and the Kashmir conflict in a global context. The book foregrounds how the space of Kashmir as a cultural, historical and political sphere persists and continues to haunt the postcolonial national present as the people of Kashmir and their cultural, literary and artistic productions cannot be contained within the regnant paradigms of the nations across which the region is partitioned. Additionally, the book explores how long-term resolution would demand engagement with historical forces, political actors and social formations that exceed the nation-state. An important contribution to the study of this troubled region, this book will be of interest to academics and researchers of modern South Asian history and politics as well as comparative politics and international relations.
