L'étude à la fois du droit international et du droit communautaire est particulièrement intéressante dans la mesure où les les deux régimes se sont influencés réciproquement. Notamment l'UE, après avoir contribué à la création des premières règles en la matière, qui ont précédé et influencé la Convention de Bâle de 1989, d'une part a modifié son régime en l'adaptant au droit international (pour ce qui est des règles de la circulation) et d'autre part n'a pas renoncé à un rôle d'avant-garde. Ce rôle a été interprété sur un double plan, car l'Union européenne a décidé d'interdire unilatéralement les transferts de déchets vers les pays en développement et -au même temps- elle s'est occupée aussi des déchets "banaux" et non seulement des déchets dangereux...
