Cet engouement est le fruit de l'évolution de la délinquance des mineurs, qui a tendance à croître, impliquant des auteurs plus jeunes.En réponse à ce phénomène, le législateur a opéré un tournant sécuritaire en 2002, marquant le point de départ du durcissement des dispositions relatives aux mineurs délinquants, notamment celles applicables à ceux âgés de seize à dix-huit ans. Il en découle un rapprochement du droit pénal des mineurs de celui des majeurs, malgré l'affirmation, la même année, par le Conseil constitutionnel d'un principe fondamental reconnu par les lois de la république qui consacre la spécificité du droit pénal des mineurs. Toutefois, il convient de s'interroger sur la portée de ce rapprochement textuel, qui est peu, voire pas mis en œuvre en pratique. Cette question se pose avec d'autant plus d'acuité depuis le changement de politique pénale impulsé en 2012 par le nouveau garde des Sceaux, qui est d'ailleurs à l'initiative d'un projet de réforme de l'ordonnance de 1945, qui entend réaffirmer la primauté de l'éducatif sur le répressif.

Si en France, les réformes de la législation relative à la minorité ont permis une amélioration du statut de l'enfant délinquant et un renouvellement significatif des réponses à la délinquance des jeunes, il n'en va pas de même en Côte d'Ivoire. Aucune réforme n'a été enregistrée depuis 1981. Ainsi, les juridictions sont-elles réduites à se contenter de quelques dispositions du code pénal et du code de procédure pénale (). Book excerpt: Belgium has a unique place in the history of migration in that it was the first among industrialized nations in Continental Europe to develop into an immigrant society. In the nineteenth century Italians, Jews, Poles, Czechs, and North Africans settled in Belgium to work in industry and commerce. They were followed by Russians in the 1920s and Germans in the 1930s who were seeking a safe haven from persecution by totalitarian regimes. In the nineteenth century immigrants were to a larger extent integrated into Belgian society: they were denied political rights but participated on equal terms with Belgians in social life. This changed radically in the twentieth century; by 1940 the rights of aliens were severely curtailed, while those of Belgian citizens, in particular in the social domain, were extended. While the state evolved into a "welfare state" for its citizens it became more of a police state for immigrants. The state only tolerated immigrants who were prepared to carry out those jobs that were shunned by the Belgians. Under the pressure of public opinion, an exception was made in the cases of thousands of Jewish refugees that had fled from Nazi Germany. However, other immigrants were subjected to harsh regulations and in fact became the outcasts of twentieth-century Belgian liberal society. This remarkable study examines in depth and over a long time span how (anti-) alien policies were transformed, resulting in an illiberal exclusion of foreigners at the same time as democratization and the welfare state expanded. In this respect Belgium is certainly not unique but offers an interesting case study of developments that are characteristic for Europe as a whole.

Book excerpt: The broad aim of this book is to provide a general basis for comparatively analysing and understanding the French riots of October/November 2005 and the corresponding Bristish disorders which occurred in the spring/summer of 2001. The first of the French riots broke out on 27 October in the north Parisian banlieue (suburb) of Clichy-sous-Bois when two teenage youths of Muslim heritage were electrocuted in a substation while fleeing from the police. The two youths had apparently become unwittingly involved, together with their friends, in a police investigation of a break-in. It is not clear whether they had actually been chased by police officers. Nevertheless, a rumor to this effect quickly circulated the locality, provoking violent confrontation between youths and police. Three more weeks of rioting then ensued in neighbouring Parisian suburbs and other major French cities with similar concentrations of ethnic minorities. The riots invariably involved thousands of youths from poorer areas who confronted the police, set fire to local buildings and ignited hundreds of motor vehicles. Further rioting - though not on the same scale as in 2005 - occurred subsequently in 2006 and 2007. England and Wales have had their own counterparts to the French riots. In the early and mid 1980s, there were a number of clashes between police and African-Caribbean youths in inner-city areas. Further, in 2001 rioting broke out in the northern mill towns and cities of Bradford, Burnley, Leeds and Oldham. All of these later instances involved youths from Pakistani or Bangladeshi descent. In contrast to the riots that occurred in France though, a contributing factor to 2001 riots was the activities of white neo-Fascists. Many official reports and academic studies followed each wave of disorder, each questioning the effectiveness of Britain's 'multicultural' society, in addition to other possible factors such as the marginalisation and 'criminalisation' of minority ethnic youth, and their relations with the police. Such issues were again on the agenda after more rioting occurred in the Lozells area of Birmingham in 2005.
