Book excerpt: Between 1988 & 1993 over fifty nations have either enacted new mining legislation, had such legislation pending adoption or were in the process of drafting new or revised legislation. In almost every case, this legislation carried with it changes in the fiscal regimes. The ability to attract mineral investment, be it in either a developed or a developing country, is partly dependent on the legislative & fiscal systems which regulate the industry. In the light of the changes taking place, this new reference work is timely & provides essential reading for those with an interest in mining taxation. The first part of the book analyses general topics which are applicable to understanding the taxation of mineral enterprises, while the second part provides a comprehensive & detailed account of actual taxation systems & methods.

Book Synopsis The Secession of States and Their Recognition in the Wake of Kosovo by : John Dugard
Download or read book The Secession of States and Their Recognition in the Wake of Kosovo written by John Dugard and published by BRILL. This book was released on 2013-08-07 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: Also available as an e-book The secession of States is subject to legal regulation. The arguments presented by States in the advisory proceedings on Kosovo confirm that there are rules of international law that determine whether the secession of a State in the post-colonial world is permissible. These rules derive from the competing principles of self-determination and territorial integrity. In deciding whether to recognize a secessionist entity as a State, or to admit it to the United Nations, States must balance these competing principles, with due regard to precedent and State practice. These lectures examine cases in which secession has succeeded (such as Israel and Bangladesh), in which it has failed (such as Biafra and Chechnya) and in which a determination is still to be made (Kosovo, Abkhazia and South Ossetia).
Book Synopsis The Quest for World Order and Human Dignity in the Twenty-first Century by : W.M. Reisman

This book was released on 2013-02-18 with total page 503 pages. Available in PDF, EPUB and Kindle. Book excerpt: International law’s archipelago is composed of legal “islands”, which are highly organized, and “offshore” zones, manifesting a much lower degree of legal organization. Each requires a different mode of decisionmaking, each further complicated by the stress of radical change. This General Course is concerned, first, with understanding and assessing the aggregate performance of the world constitutive process, in present and projected constructs; second, with providing the intellectual tools that can enable those involved in making decisions to be more effective, whether they are operating in islands or offshore; and, third, with inquiring into ways the international legal system might be improved. Reisman identifies the individual as the ultimate actor in international law and explores the dilemmas of meaningful individual commitment to a world order of human dignity amidst interlocking communities and overlapping loyalties.
Book Synopsis Pan-Africanism and International Law by : Abdulqawi A. Yusuf
Download or read book Pan-Africanism and International Law written by Abdulqawi A. Yusuf and published by Martinus Nijhoff Publishers. This book was released on 2015-01-08 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: Pan-Africanism offers a unique vantage point to study Africa’s encounters with international law : first, as a continent whose political entities were excluded from the scope of application of the Eurocentric version of international law that was applied among the self-styled club of “civilized nations” ; second, through the emergence of African States as subjects of international law willing to contribute to the reform and further development of the law as a universal interstate normative system; and third, as members of the OAU and the AU acting collectively to generate innovative principles and rules, which, though applicable only in the context of intra-African relations, either go beyond those existing at the universal level or complement them by broadening their scope. This study examines those encounters through the various stages in the evolution of Pan-Africanism from a diaspora-based movement, engaged in the struggle for the emancipation of the peoples of the continent, to groupings of independent States and intergovernmental organizations which continue to promote African unity and influence the development of international law to make it more reflective of diverse legal traditions and values.

Book Synopsis Functional Jurisdiction in the Law of the Sea by : Maria Gavouneli
Download or read book Functional Jurisdiction in the Law of the Sea written by Maria Gavouneli and published by BRILL. This book was released on 2007-12-31 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Law of the Sea Convention has now reached 25 years of presence in the international scene as a constitution for the oceans. It was the product of a long and arduous negotiation with a final product of delicate balance. The purpose of this book is to examine whether the basic premises and essential compromises of the Convention still hold true or whether the Convention, as a living instrument, has evolved into accommodating new needs and challenges to its regulatory scheme. The vehicle chosen is the jurisdictional interplay between the States, as flag States, coastal States and port States, and the world community at large in matters relating to navigation, fisheries, access to the biological resources of the deep seabed or even maritime security. The result confirms the solid foundations of the Convention and its ability to evolve and expand without upsetting its essential balance. A book useful to all those interested in the law of the sea and the structure of international law.

Book Synopsis La Convention sur l'interdiction et l'élimination des armes chimiques by : Daniel Bardonnet
Download or read book La Convention sur l'interdiction et l'élimination des armes chimiques written by Daniel Bardonnet and published by Martinus Nijhoff Publishers. This book was released on 1995-11-17 with total page 676 pages. Available in PDF, EPUB and Kindle. Book excerpt: After twenty years of negotiation within the framework of the Disarmament Conference, the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction was signed in Paris between 13 and 15 January 1993. At the same time, the signatory States adopted a resolution instituting a Preparatory Commission, established in The Hague, with the aim of 'the prompt and effective establishment of the future Organization for the Prohibition of Chemical Weapons'. A variety of converging considerations led the Curatorium of the Academy of International Law to organize a workshop on this subject: first the very interesting nature of the highly sensitive problems raised by the destruction of chemical weapons, both on the strategic and political planes, as well as on technical, financial and ecological grounds; but also the originality and difficulty, from the legal standpoint, of the numerous questions which will inevitably arise in connection with the application of the Paris Convention. Finally, the Paris Convention, which is innovative in many respects, particularly in that it institutes international control over the whole of an industrial activity, may be used as a model in other areas of disarmament, in particular the area of nuclear weapons.
