Le Législateur présente le Codex iuris canonici de 1983 comme étant un instrument indispensable pour assurer l'ordre aussi bien dans la vie individuelle et sociale que dans l'activité de l'Eglise elle-même . Cette nouvelle législation de l'Eglise catholique latine formule, en des termes juridiques, la théologie conciliaire issue de Vatican II. Cette dernière conçoit l'Eglise comme une communion, au sein de laquelle le principe de subsidiarité soutient une véritable interaction entre loi universelle et loi particulière. La place du ius particulare dans le droit de l'Eglise est singulièrement accentuée dans le Code des canons des Eglises orientales (CCEO), promulgué en 1990. Pour des raisons tenant plus particulièrement au respect des traditions propres à ces Eglises, une large part y est laissée au droit particulier, réel mode d'expression de l'unité dans la pluralité au sein de l'Eglise universelle. Le droit universel donne ainsi au droit particulier sa signification ; il circonscrit ses domaines d'application et éclaire les enjeux liés à sa mise en oeuvre, conformément à la tradition normative de l'Eglise. Les Actes ici publiés entendent mettre en lumière ces différents aspects du droit particulier dans une perspective résolument comparée, et évaluer la réalité et la vivacité des droits particuliers au sein des communautés ecclésiales, dans l'Eglise latine comme dans les Eglises orientales catholiques. Ils contribuent à nourrir la réflexion de tous ceux qui s'interrogent sur l'opportunité de promouvoir davantage le ius particulare au sein de l'Eglise catholique.

Mercy applies to the fallible individual deserving of punishment, but who is saved by grace. This is most apparent in the Sacrament of Penance and other forms of penitence, forgiveness, and reconciliation where mercy both transcends and undermines justice. His Civil Code was enforced in the new Duchy too and, unlike the Catholic Church, it allowed the dissolution of marriage by divorce. This book sheds new light on the application of Napoleonic divorce regulations in the Polish lands between 1808-1852. Unlike what has been argued so far, this book demonstrates that divorces were happening frequently in 19th century Poland and even with the same rate as in France.
