En effet, ces outils offrent aux particuliers la possibilité de consulter les créations au moment, dans le lieu et pendant le temps qu’ils souhaitent, affirmant dès lors l’ubiquité des œuvres d’art. Pourtant, si le droit d’auteur avait su recevoir le progrès technique avec souplesse pour maintenir un équilibre entre la diffusion des œuvres au sein du public et le respect des droits des créateurs, ce mémoire conduira à démontrer, au terme d’une analyse comparée où le droit français sera appuyé par des incursions en droits canadien et québécois, que les facultés d’accès sont telles, qu’elles bouleversent l’organisation des relations qui préexistaient entre ces protagonistes, fragilisant ainsi la protection juridique de l’auteur. En effet, face à son souhait de voir son investissement artistique récompensé et protégé, il se dresse un public aux revendications nouvelles. En quête d’un accès gratuit à une multitude d’œuvres, ce dernier conteste d’abord le monopole de l’auteur et favorise l’apparition d’intermédiaires qui, en générant de nombreux profits sans rémunérer le créateur, sont à l’origine d’un phénomène de captation de valeur. Désireux de participer activement à l’accès en diffusant les œuvres à ses semblables, il s’est ensuite érigé, par l’accomplissement d’actes d’exploitation, en contre facteur. Dans ce nouveau contexte, d’autant plus complexe que l’activité du public et des intermédiaires participe à la visibilité des œuvres d’art, la recherche d’un équilibre pour mieux protéger les droits d’auteur est apparue indispensable. A cette fin, différents mécanismes techniques et juridiques ont dû être adoptés.
