But rather than approaching secession through the optic of political or nationalist institutional accommodation, this book focuses on the underpinnings to a constitutional order as a law-making community, underpinnings laid bare by secession pressures. Relying on the corrosive effects of secession, it explores the deep structure of a constitutional order and the motive forces creating and sustaining that order. A core idea is that the normativity of law is best understood, through a constitutional optic, as an integrative, associative force. Constitutionalising Secession critically analyses conceptions of constitutional order implicit in the leading models of secession, and takes as a leading case-study the judicial and legislative response to secession in Canada. The book therefore develops a concept of constitutionalism and law-making - 'associative constitutionalism' - to describe their deep structure as a continuing, integrative process of association. This model of a dynamic process of value formation can address both the association and the disassociation of constitutional systems.

Tantôt c'est le souci d'une bonne administration de la justice qui les motive. Il en est ainsi en cas de concentration d'u contentieux donné devant une seule juridiction. Tantôt c'est la commodité du justiciable qui les justifie. Tel est le cas quand le justiciable a la faculté de saisir le tribunal dans le ressort duquel les preuves sont plus facilement exploitables. Quand cette possibilité est ouverte, divers procédés permettent même au justiciable de désigner la personne de son juge. Alors la justification, qui relève de l'exigence d'une bonne justice, se trouve dans le souci d'obtenir une décision rendue par un juge au-dessus de tout soupçon de partialité. Choix de la juridiction et choix de la personne du juge constituent, pour le justiciable, de véritables droits qui trouvent leurs sources dans divers textes et dont l'exercice est suivi d'effets juridiques. En effet, ce droit s'impose au juge, mais également aux parties. Comme toute autre prérogative, les droits ici concernés sont subordonnés à un comportement loyal du justiciable. L'étude de ces droits ne manque pas d'intérêts. Elle permet de montrer qu'il peut y avoir un lien entre les questions relatives à l'organe qui rend une décision juridictionnelle et celles ayant trait à l'auteur de cette dernière. Elle met aussi en valeur les exigences d'une bonne administration de la justice et d'une bonne justice. Enfin, elle met en lumière l'influence du droit européen sur les procédures nationales.

In tracing Rétif's persistent but frustrated attempts to reconcile the conflicting elements of the world he inhabits -- rural and urban, old and new, stable and changing -- this volume analyses the failure of his utopian dream of a well-ordered and harmonious society. By exploring his absorption in the autobiographical project, and in particular Monsieur Nicolas ou le coeur humain dévoilé, it offers an interpretation of his work as a sustained reflection on selfhood and on the power of memory which enables Rétif to create, within the confines of the text, a utopian space where self and world are reconciled, and time and space no longer count.
