Book excerpt: The release of Denys Arcand's Le Déclin de l'empire américain (The Decline of the American Empire) in 1986 marked a major turning point in Quebec cinema. It was the first Québécois film that enjoyed huge critical and commercial success at home and abroad. Arcand's tragicomedy about eight intellectuals gathered around a dinner table relating sexy anecdotes became the top-grossing film of all time in Quebec and was the first Canadian feature to be nominated for an Oscar in the foreign-language category. Seventeen years later, Arcand won an Academy Award for the sequel, Les Invasions barbares (The Barbarian Invasions), where the amusing insouciance of the thirty-somethings talking dirty in Le Déclin is replaced by a sense of moral responsibility and serene resignation. In this engrossing study, André Loiselle presents the first in-depth analysis of both films within the context of Quebec culture. Through close readings and concise cultural analysis of two of the most important films in the history of Quebec cinema, Loiselle demonstrates the ways in which Arcand's work represents a snapshot of the evolution of the French Canadian film industry since 1980. The companion films trace the decline of Quebec's national dream and the Québécois' attempts to cling to their identity against the forces of barbaric globalization. The second title in the new Canadian Cinema series, Denys Arcand's "Le Déclin de l'empire américain" and "Les Invasions barbares" is essential reading for cinephiles, film critics, and anyone with an interest in cultural studies and Canadian and Quebec history.

Available in PDF, EPUB and Kindle. Book excerpt: As we move towards a more global legal community, often with accompanying injustice and violence, Mireille Delmas-Marty demonstrates that there is an urgent need to reconstruct the national and international legal landscapes. Legal reasoning can be applied to concepts such as human rights for European citizens in the new world order. In this book the author argues for a rule of law that is common in every sense of the word: accessible to all rather than reserved exclusively for officials, common to the various legal sectors despite increasing specialization, and common to diverse States. The book will be of interest to all comparative European lawyers, and to social scientists and legal theorists grappling with contemporary issues in legal pluralism and globalization.

Book excerpt: In October I873, as every Conference Report recalls, the Associ ation for the Reform and Codification of the Law of Nations was founded in Brussels (Belgium). At the Brussels Conference of I895 the Association's name was changed and ever since it has been "The International Law Association". On August 30 and 3I and September I, I973, a Centenary Cele bration will be held in the Association's place of birth. In the course of preparations made for this triduum, plans were also laid by the Executive Council for a Centenary Volume to mark the event. The formula adopted for the book was mostly based on contributions by Chairmen and/or Rapporteurs of International Committees of the Association who were asked to shed light on "the present state" of their subject. Hence the title of the Volume. For good measure, vari ous other topics not coming under the terms of reference of Inter national Committees were added. Almost all of the authors invited responded favourably, and their studies are to be found in Part II, arranged in sections which have no other justification than the Editor's whim. It should be pointed out that Chairmen and/or Rapporteurs of International Committees wrote their articles a titre personnel and, therefore, cannot be deemed to express opinions held by their Com mittees as such. Part I contains the "other essays", dealing with the Association itself rather than with the present state of international law.

Available in PDF, EPUB and Kindle. Book excerpt: In addition to his groundbreaking contributions to pure economic theory, F. A. Hayek also closely examined the ways in which the knowledge of many individual market participants could culminate in an overall order of economic activity. His attempts to come to terms with the "knowledge problem" thread through his career and comprise the writings collected in the fifteenth volume of Routledge's Collected Works of F. A. Hayek series. The Market and Other Orders brings together more than twenty works spanning almost forty years that consider this question. Consisting of speeches, essays, and lectures, including Hayek's 1974 Nobel lecture, "The Pretense of Knowledge," the works in this volume draw on a broad range of perspectives, including the philosophy of science, the physiology of the brain, legal theory, and political philosophy. Taking readers from Hayek's early development of the idea of spontaneous order in economics through his integration of this insight into political theory and other disciplines, the book culminates with Hayek's integration of his work on these topics into an overarching social theory that accounts for spontaneous order in the variety of complex systems that Hayek studied throughout his career. Edited by renowned Hayek scholar Bruce Caldwell, who also contributes a masterly introduction that provides biographical and historical context, The Market and Other Orders forms the definitive compilation of Hayek's work on spontaneous order.

Book excerpt: In The Rule of Law, Justice, and Interpretation Luc Tremblay analyses and refutes the positivist legal theory that prevails in Canadian constitutional practice. Using the techniques of critical theory, hermeneutic interpretation, and analytical jurisprudence he shows that the dominant interpretations of the central legal doctrines of the rule of law and the sovereignty of Parliament are incoherent. The analysis opens the way for the construction of a bold alternative theory of legal discourse and practice based on the concept of the rule of law itself.

Available in PDF, EPUB and Kindle. Book excerpt: The contributions brought together in this book derive from joint seminars, held by scholars between colleagues from the University of Oxford and the University of Paris II. Their starting point is the original divergence between the two jurisdictions, with the initial rejection of the public-private divide in English Law, but on the other hand its total acceptance as natural in French Law. Then, they go on to demonstrate that the two systems have converged, the British one towards a certain degree of acceptance of the division, the French one towards a growing questioning of it. However this is not the only part of the story, since both visions are now commonly coloured and affected by European Law and by globalisation, which introduces new tensions into our legal understanding of what is "public" and what is "private".

Available in PDF, EPUB and Kindle. Book excerpt: The French Constitutional Council, a quasi-judicial body created at the dawn of the Fifth Republic, functioned in relative obscurity for almost two decades until its emergence in the 1980s as a pivotal actor in the French policymaking process. Alec Stone focuses on how this once docile institution, through its practice of constitutional review, has become a meaningfully autonomous actor in the French political system. After examining the formal prohibition against judicial review in France, Stone illustrates how politicians and the Council have collaborated over the course of the last decade, often unintentionally and in the service of contradictory agendas, to significantly enhance Council's power. While the Council came to function as a third house of Parliament, the legislative work of the government and Parliament was meaningfully "juridicized." Through a discussion of broad theoretical issues, Stone then expands the scope of his analysis to the politics of constitutional review in Germany, Spain, and Austria.

Available in PDF, EPUB and Kindle. Book excerpt: The history and theory of international law have been transformed in recent years by post-colonial and post-imperial critiques of the universalistic claims of Western international law. The origins of those critiques lie in the often overlooked work of the remarkable Polish-British lawyer-historian C. H. Alexandrowicz (1902-75). This volume collects Alexandrowicz's shorter historical writings, on subjects from the law of nations in pre-colonial India to the New International Economic Order of the 1970s, and presents them as a challenging portrait of early modern and modern world history seen through the lens of the law of nations. The book includes the first complete bibliography of Alexandrowicz's writings and the first biographical and critical introduction to his life and works. It reveals the formative influence of his Polish roots and early work on canon law for his later scholarship undertaken in Madras (1951-61) and Sydney (1961-67) and the development of his thought regarding sovereignty, statehood, self-determination, and legal personality, among many other topics still of urgent interest to international lawyers, political theorists, and global historians.
