A sa place, un système ad hoc, celui des opérations de maintien de la paix, a vu le jour afin de résoudre les crises internationales. Le Conseil de sécurité a progressivement délégué l'exécution de ses résolutions au Secrétaire général, à l'Assemblée générale, à ses Etats membres et à des organisations régionales. Il s'est ainsi déchargé de l'exécution des décisions militaires et du contrôle de leur mise en œuvre. Le développement des opérations de maintien de la paix a toutefois montré leurs limites politiques, opérationnelles et conceptuelles. Le Conseil de sécurité a-t-il appris les leçons de ses échecs ? Peut-il être doté, aujourd'hui ou demain, d'une force armée ? Comment améliorer l'efficacité des mécanismes de sécurité actuels ? L'objet de l'ouvrage est de réfléchir aux méthodes pouvant installer ou réinstaller le Conseil de sécurité au centre des processus de décision et d'action militaires.

Les membres permanents vont tenter d'instrumentaliser le Conseil de sécurité afin de diminuer l'illégalité de la situation. Ceci pose avec acuité le problème du contrôle de son activité en matière de maintien de la paix. L'accomplissement d'un acte illégal par un ou plusieurs membres permanents du Conseil de sécurité nécessite alors de réfléchir à des moyens d'ordre juridique pour limiter son pouvoir. Cette réflexion s'avère particulièrement pressante lorsque le Conseil est confronté à une occupation de guerre impliquant ses membres permanents ou, lorsqu'il crée ou autorise des opérations de paix de grandes envergures suite à un conflit armé impliquant ses membres permanents. Afin de limiter les prérogatives du Conseil de sécurité, le régime juridique de l'occupation tel qu'énoncé par le Règlement de La Haye (IV) de 1907 et la IVe Convention de Genève de 1949 devrait être appliqué par l'organe politique onusien lorsqu'il intervient dans une situation d'occupation de guerre impliquant ses membres permanents. L'objectif est d'éviter qu'il n'attribue aux puissances occupantes des missions qui dépassent le cadre juridique imposé par le droit des conflits armés. L'autorisation, par le Conseil de sécurité d'opérations de paix, telles qu'une administration civile transitoire ou une force multinationale avec un mandat de la paix avec recours à la force armée, suite à un conflit armé impliquant ses propres membres permanents, ouvre le débat sur leur réglementation. Alors, il sera proposé une interprétation progressiste de la définition de l'occupation telle qu'énoncée par le Règlement de La Haye (IV) de 1907 et la IVe Convention de Genève de 1949 afin d'y intégrer ces nouvelles formes d'occupations pacifiques, présentant de grandes similitudes avec les occupations de guerre. Ainsi, le régime juridique de l'occupation pourra leur être appliqué.

Transitional administrations represent the most complex operations attempted by the United Nations. The operations in East Timor and Kosovo are commonly seen as unique in the history of the UN - perhaps never to be repeated. But they may also be seen as the latest in a series of operations that have involved the United Nations in 'state-building' activities, where it has attempted to develop the institutions of government by assuming some or all of those sovereign powers on a temporary basis. The circumstances that have demanded such interventions certainly will be repeated. Seen in the context of earlier UN operations, such as those in Namibia, Cambodia, and Eastern Slavonia, the view that these exceptional circumstances may not recur is somewhat disingenuous.
