Book excerpt: Selon une doctrine classique sans doute encore dominante aujourd'hui, le droit du travai se serait construit pour pallier à l'inaptitude du Code civil à régir adéquatement les rapports entre employeurs et salariés. Le Code civil serait, selon certains, à l'origine de certains maux dont souffrirait le droit du travail et devrait être mis à l'écart à chaque fois que cela est possible. Cependant, paradoxalement, les articles L. 121-1 et L. 120-2 autorisent la participation du Code civil à l'ordonnancement des relations du travail. De plus l'analyse des décisions de justice montre que loin d'être marginales, les manifestations du Code civil en la matière sont à la fois diverses et multiples. En effets, contairement à ce que l'on à pu écrire et à ce que laisse entendre l'article L.121-1 du code du travail qui vise le "droit commun", les dispositions du droit des obligations ne sont pas seules en cause : le livre premier consacré aux "personnes" est également sollicité ( notamment les articles 7 et 9 du Code civil). Enfin, sur un plan plus théorique, même si le droit du travail est incontestablement doté de règles et de principes qui sont spécifiques, il n'est pas un droit autosuffisant (autonome) et, à ce titre, il a besoin du renfort du Code civil qui fait figure de droit autonome. Cependant, si la contribution du Code civil est possible en la matière c'est le plus souvent parce que les règles "civilistes" subissent des inflexions particulières dans leurs applications aux relations du travail ou reçoivent des exceptions purement prétoriennes. Etudier le jeu du code civil conduit ainsi à démontrer à la fois l'ambivalence des rapports que ce Code entretient avec le droit du travail et la réversibilité de ses techniques. cette faculté d'adaptation dont font preuve les dispositions du Code civil est riche d'enseignement au niveau de la théorie. Elle montre, d'une part, que le texte du Code civil ne correspond pas forcément à la règle de droit civil et qu'il a une texture ouverte. D'autre part, cette distance entre le texte visé et la solution adoptée en droit du travail au regard de ce texte est également un élément supplémentaire à verser au dossier de l'appréhension non-déontique et instrumentale de la règle de droit.

An understanding of the factors that have contributed to this fundamental change in economic and social conditions is of crucial significance if we are to preserve an equitable balance in the employer-employee relationship. The eleven papers reprinted here were originally presented at the 16th Congress of the International Academy of Comparative Law, held in Brisbane in July 2002. Each paper is organized around the following considerations for the particular country in question: factors determining the role of collective agreements; factors determining the regulatory power of collective agreements toward the employment contract; factors limiting the regulatory power of collective agreements; degree of fredom of the parties to shape the employment contract; and future prospects for collective agreements as a means of regulating the employment contract. Underlying issues of decentralization, minimum standards, decreasing unionization, unemployment, and the growing individualization of the employment contract are addressed by all the authors. In fact, as The Environment for Women's Entrepreneurship in the Middle East and North Africa shows, there is very little difference between mail- and female-owned firms. Female-owned firms in the region are as well-established, productive, technologically savvy, and connected to global markets as male-owned firms. Although there are many similar characteristics and performance levels between male- and female-owned firms in the region, the book notes that women's entrepreneurship isn't reaching its potential, despite an investment climate that is much less gendered than suspected. With a significant increase in women's education level-in 11 out of 18 countries in the region women outnumber men in universities-and the strong economic rights women have in Islam, women's entrepreneurship can become a far greater engine for growth and diversification than expected in the past. This potential needs to be exploited vigorously. Reforming the investment climate to benefit all players is one important action. The second would be to remove or mitigate hurdles to their economic and social empowerment.

(My intention then was to flog the dead (?) horse of the merger of comparative law and the sociology of law. ) In presenting this voluminous collection of Netherlands national reports to the eleventh congress of the Internatio nal Academy of Comparative Law I feel my misgivings giving way to the suspicion, that comparative law indeed exists. Of course national reports do not, as such, prove the exist ence of comparative law. It is the general reports together with the national reports, which embody the comparative effort. That is why the Netherlands Comparative Law Associa tion took the initiative to propose the publishing of the materials on a subject to subject basis instead of publish ing collections of national reports. From a comparative legal point of view, it is the topic that should form the basis of the publication, and not the origin of the materials. The general reporter for each topic should be prepared to take up the responsabilities of editing the volume, and would have to be given the right to select those national reports which he considers to be useful both in regard to their quality and the relevance of the material to the basic problems in the questionnaire. This proposal met with very favourable comments from the na tional committees and general reporters of some fifteen coun tries.
