Le législateur OHADA s'étant jusqu'ici astreint à réglementer les entreprises dites capitalistes. Ce renouveau était très attendu pour au moins une catégorie de coopérative : la coopérative d'épargne et de crédit dont le cadre juridique se caractérisait par son caractère disparate et les faillites qui meublaient les chroniques juridiques. Il devenait donc intéressant de s'interroger sur le cadre juridique des sociétés coopératives d'épargne et de crédit dans l'espace OHADA. Cette réflexion a pour fil d'Ariane l'examen des solutions élaborées par le législateur en vue d'accroitre l'efficacité des sociétés coopératives d'épargne et de crédit. Ce nouveau cadre juridique est marqué par ce que nous identifions comme un hybridisme justifié mais aussi par une segmentation peu convaincante de ce cadre juridique. Un hybridisme du cadre juridique au regard de la marque certaine des principes coopératifs mais aussi par un emprunt des principes capitalistiques dans le cadre juridique d'une société de l'économie sociale et solidaire. Une segmentation peu convaincante du cadre juridique du fait du maintien risqué de la multiplicité des sources formelles du droit des sociétés coopératives d'épargne et de crédit. Maintient qui nous a mené à la quête d'un cadre juridique unifié et cohérent des sociétés coopératives d'épargne et de crédit.

In a context where liberalizing trade has not produced the expected gains in developing countries and growth in global trade has not led to the expected economic growth, an alternative solution has emerged. This new paradigm suggests that trade liberalization should be accompanied by public investment. However, by its very nature, trade liberalization leads to a reduction in revenues from duties and taxes, which means that the available resources for public investments will also be reduced. There are now solid arguments for encouraging the less-developed countries to first emphasize regional integration before trying to access the global market.
