Book excerpt: Georges Abi-Saab began his writing and teaching at a time when the process of decolonization, and thereafter the quest for emancipation, began to make its far-reaching impact on the international scene, producing significant changes in the international environment, both quantitatively in increasing the number of nation-States and qualitatively in changing patterns of interests and claims. This was bound to result in new pressures on the international legal system itself and in a questioning of the traditional Eurocentric content of international law. In his work and teaching Professor Abi-Saab viewed the dynamics of international law as a function of two driving forces: the emergence of the third world and the sense of injustice. In his view, the first driving force - the emergence of the third world - raised the problem of exclusion: exclusion from participation in the elaboration of international law and the decision-making process, and exclusion as beneficiaries of the resulting rules of international law. At the same time, this new force introduced diversity into the international scene, reflecting the richness of the international community in its different facets. This process remains relevant today, reflecting the contemporary problem of exclusion of new actors as well as their quest for participation. The second driving force - the sense of injustice - posed a teleological problem for him, that of defining community values in order that they capture the different facets of justice, whether formal or distributive. So long as there is no effective organic structure, international law in his view will continue to remain effectiveness-oriented, reflecting rather than impacting on the structures of power. Nevertheless, it is undeniable that there is an on-going process of development of community values and interests; as Georges Abi-Saab wrote with reference to international crimes: `law, like all social phenomena, is a continuous unfolding, a continuous process of elaboration'. He has also considered that the dynamics of the international legal process itself can be captured from the perspective of international organizations as vehicles for change in the international system. From his early writings, Georges Abi-Saab approached the United Nations Charter as a blueprint - both normative and institutional - for a certain type of international society. International institutions with all their imperfections, continue for him to be the means of realization of the law of cooperation which lies at the heart of his concept of the international system. The themes selected for this volume in honour of Professor Georges Abi-Saab are intended to reflect his unique and pioneering contribution to the field of international law. The contributors are drawn from what he has always considered to be his large `family' of former students: in his forty years of teaching, Georges Abi-Saab has acted as mentor to generations of students from all over the world who have benefited from his vision, insights, originality and creative and stimulating use of language. The contributors also include colleagues and friends who share a similar vision of the international legal system.

Available in PDF, EPUB and Kindle. Book excerpt: The second revised edition of this acclaimed book brings the story of the EU's constitutional journey up to date. The EU's constitution, composed of a myriad of legal texts, case law and practice, is a moving target subject to continuous change, and the past two years have seen no slacking in the pace of that change. With a wider geographical ambit than ever, the EU faces unprecedented political, economic and cultural challenges, all of which impact upon the evolution of its constitution. Moreover, the crisis in the Eurozone has given rise to the need for a whole new chapter focussing on the institutional reforms embarked upon in the quest to restore financial order. The book succeeds, where others have struggled, in making sense of the EU's complex constitutional order, focussing on its essential features but taking into account the profound changes that have taken place over the past 20 years. The EU has become much more than an internal economic market and has recently become active in areas such as immigration and third-country nationals, security and defence policy, and penal law and procedure, while the crisis in the Eurozone has triggered an increasing focus on economic and fiscal policy. Eschewing too much detail the authors underline the essential values, principles and objectives of the integration regime as well as its basic normative structure and hierarchy. In this context, the decentralised nature of the EU is highlighted as an integral part of its constitutional make-up. Recurring themes include European citizenship, fundamental rights and the rule of law. The book also confronts head-on the problems and challenges facing the Union and the gap which is often perceived between lofty ideals and harsh realities. The book will be useful to students of EU law and European integration but will also appeal to a broader audience of researchers and practitioners, including political scientists.

Available in PDF, EPUB and Kindle. Book excerpt: In October 2005, three weeks of rioting erupted in France following the accidental deaths of two French boys of North African ancestry. Killed while fleeing the police, these boys were deemed dangerous based largely on their immigrant origins. In France, disadvantaged children of immigrant and foreign ancestry represent the vast majority of formal suspects and have increasingly been portrayed as a threat to public safety and as the embodiment of the assault on French values. Despite official rhetoric of protection, Judging Mohammed reveals how the treatment of these children in the juvenile courts system undermines legal guarantees of equality and due process and reinforces existing hierarchies. Based on five years of extensive research in the largest and most influential juvenile court in France, this work follows young people inside the system, from arrest to court trials. Revealing an alarming turn toward accountability, restitution, and retribution, this groundbreaking study uncovers the disquieting reasons behind France's shifting approaches to the identification, treatment, and representation of its delinquent youth.

Available in PDF, EPUB and Kindle. Book excerpt: Canadian advocacy has evolved over the past few decades. A core function of the nonprofit sector, advocacy endures in an unsympathetic neoliberal landscape – one dominated by a rise in government surveillance, ongoing government funding cuts, and confusion over what activities are permissible. Exploring the unpredictable and fluid nature of public policy advocacy work carried out by nonprofit organizations across Canada, The Shifting Terrain sheds light on the strictures and opportunities of this crucial aspect of the voluntary sector. Authors from diverse backgrounds, including academics, activists, practitioners, and legal experts, illustrate what the shifting course of advocacy means in philosophical, theoretical, political, and practical terms. Offering a critique of advocacy practices directed at the nonprofit–provincial/territorial government interface and beyond, this anthology outlines regulatory changes made by the Canada Revenue Agency, exposes the conflicted internal structures and processes of advocacy work, challenges "permissible advocacy activities," presents provocative thinking about alternative ways forward, and proposes recommendations for improvement. A comparative historical study and a contemporary examination, The Shifting Terrain invites readers to contemplate the implications of advocacy for public participation, the shaping of public policy, and Canadian democracy.
