Available in PDF, EPUB and Kindle. Book excerpt: Examines the Impact of the Idealism of the Personal Liberty Laws of Pennsylvania, New York, Massachusetts, Ohio and Wisconsin The Personal Liberty Laws reflected the social ethical commitment to freedom from slavery and as such were among the bricks that laid the foundation for the Fourteenth Amendment. Morris examines those statutes as enacted in the five representative states Pennsylvania, New York, Massachusetts, Ohio and Wisconsin, and argues that these laws were an alternative to the violence allowed by the southern slave codes and the extreme abolitionist viewpoints of the north. Book excerpt: Addressed to the large body of English men who, while inclined to individualism,'' inconsistently appeal to socialism for the attainment of certain ends which at first sight seem to be unattainable under a regime of freedom." Questions of libel, of cruelty to animals, of copyright, of adulteration, of the relation of the sexes, of rights over land, of nuisance and many others. Mr. Donisthorpe considers difficult to solve straight off on the principle of equal liberty. Still that they may be so solved he shows in nine chapters which discuss many social questions from both the Individualists and Socialists standpoint.

Purchasers can download a free scanned copy of the original book (without typos) from the publisher. Not indexed. Not illustrated. 1833. Excerpt: ... CHAPTER VIII. Observations on the tendency in government to dissolution, from a corruption of its principles.--Plan of reformation incorporated in the constitution.--Its probable effects in perpetuating its duration..Montesquieu, speaking of that kind of government, which was established through Europe try the conquerors of the Roman Empire, says--" It was a good government that had in itself a capacity of growing better." This capacity of growing better was not the effect of any direct intention of the founders, nor, if perceived, was its cultivation, generally, an object of pursuit. Accordingly, we have seen this kind of government almost universally, degenerating into a species of despotism, under an absolute monarchy, or an aristocracy equally absolute. If any of those governments have admitted improvements, these improvements never have been deliberately made, in consequence of any plan of reformation adopted in the constitution. They have been constantly introduced by violence, or, in a concurrence of circumstances, little, if at all intended or foreseen. Notwithstanding the foregoing observation of Montesquieu, he appears to join in the opinion, which has very generally prevailed, that governments, like men, carry in themselves from their very origin, the seeds of dissolution; that man is fatally incapable of forming any which shall endure without degenerating. I am, however, apprehensive, that on enquiry, we may, so far as it relates to government, find reason to doubt the correctness of this opinion. A more general development of the laws of social nature, and the principles resulting from those laws, may discover, that although in the infancy of mankind, from which, perhaps, those nations who have made the greatest advances, have hardly emerged, ...

Download or read book The Development of State Legislation Concerning the Free Negro written by Franklin Johnson and published by Forgotten Books. This book was released on 2017-10-13 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Development of State Legislation Concerning the Free Negro: Submitted in Partial Fulfilment of the Requirement for the Degree of Doctor of Philosophy in the Faculty of Political Science in Columbia University It is evident that complete generalizations concerning the general trend of legislation affecting the negro cannot be based on the laws dealt with in this volume alone. Only the carrying out of the original plan would have made possible a valid general summary of the trend of legislation concerning the negro in this country. It is the author's hope, however, that a complete review of the field indicated will prove more valuable than the possible results of an attempt to deal in an incomplete manner with the whole field. The thorough treatment undertaken has involved much labor and difficult investigation. It would have been impossible except for the libraries of the New York Bar Association and the New York Law Institute, where the larger part of the investigation was done. Book excerpt: Excerpt from Law in a Free State Twenty years ago I took a census of the indi vidualists in this country, and I found that they could all be seated comfortably in a Bayswater 'bus. Twelve years ago I took another, and I found that their number had increased to about three hundred. This increase I attributed mainly to the teachings of Mr. Herbert Spencer. At the present time the in dividualists of England may be counted by thousands, and perhaps tens of thousands. I attribute this further increase partly to the same cause, partly to the efforts of the Personal Rights Defence Associa tion and the Liberty and Property Defence League, and partly to the visible evil effects of the practical State socialism of the Legislature. Book Synopsis Free Will and the Law by : Allan McCay
Download or read book Free Will and the Law written by Allan McCay and published by Routledge. This book was released on 2019 with total page 238 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume brings together many of the world¿s leading theorists of free will and philosophers of law to critically discuss the ground-breaking contribution of David Hodgson¿s libertarianism and its application to philosophy of law. The book begins with a comprehensive introduction, providing an overview of the intersection of theories of free will and philosophy of law over the last fifty years. The eleven chapters collected together divide into two groups: the first five address libertarianism within the free will debate, with particular attention to Hodgson¿s theory, and in Part II, six contributors discuss Hodgson¿s libertarianism in relation to issues not often pursued by free will scholars, such as mitigation of punishment, the responsibility of judges, the nature of judicial reasoning and the criminal law process more generally. Thus the volume¿s importance lies not only in examining Hodgson¿s distinctive libertarian theory from within the free will literature, but also in considering new directions for research in applying that theory to enduring questions about legal responsibility and punishment.¿
