Book excerpt: Excerpt from Laws of the State of North Carolina, Passed by the General Assembly, at the Session of 1848-'49: Published Agreeably to the Ninety-Fifth Chapter of the Revised Statutes Sec. Thlitthe board of directors may call for the pevz'ncstof the sums subscribed as stock in said company in such instalments as the ll3181'88[ of said company may, in. Their opinion, require: the call for each payment shall be published in one or more newspapers in this State for the soace of one month before the day ofpayment; and on failure of any stockholder to pay each instalment as thus required, themrectors may sell at public auction, on a previous notice often days for cash, all the stock subscribed for said com party, by such stockholder, and convey the same to the pur cnaser at said sale; and ifsaid sale of stock do not produce a sum sufficient to pay offthe ineldental expenses ofthe sale, and the entire amount owing by such stockholder to the company for such subscription of stock, then andin that case the Whole of such balance shall be held and taken as due at Payment once to the company, and may be recovered of such stock-ok holder or his executors, administrators or assigns, at the suit of said company, either by summary motion in any court of superiorjurisdiction 1n the county where the delinquent resides, on a previous hence of ten days to said subscriber, or by the action of assumpsit in any court ofcompetentjuriso diction, or by a warrant before a justice of the peace, where the sum does not exceed one hundred dollars; audin all cases of assignment of stock, before the whole amount has been paid to the company, then for all sums due on such stock, both the original subscribers, and the first and all subsequent assignees Shall be liable to the company, and the some may be recovered as above describe d.
