In a step-by-step presentation from arrest to incarceration each chapter will discuss a specific part of the legal system. As well as providing information on the topic, this book can serve as an important resource to the myriad of issues and difficulties that may be experiences by the Deaf suspect, defendant, or inmate, as well as by law enforcement officers, attorneys, and correctional officers. To illustrate these issues, previous cases of Deaf suspects, defendants, and inmates will be presented and discussed to clarify key issues and to provide a perspective of the problem. Each chapter dealing with these issues will also provide suggestions for more culturally competent interactions between the Deaf community and the legal system.

Book excerpt: Research shows there is a separation between the hearing community and the Deaf community in terms of communication. While there is little research specific to interactions between law enforcement and the Deaf community, it is probable a communication barrier exists between law enforcement officers and the Deaf community as well, due to law enforcement officers not being properly trained to interact with this community of individuals. This study examines law enforcement officers’ perspectives of working with the Deaf community. Using qualitative data collected through interviews, law enforcement officers in central Texas provided insight based upon their experiences with members of the Deaf community. From these interviews it was found that law enforcement officers are not receiving efficient training to prepare them for interactions with individuals with communications barriers, like Deaf individuals. The findings of this exploratory qualitative study revealed support for continued research examining the experiences of law enforcement officers with the Deaf community as well as the possible need for further training for law enforcement in this area.

Book excerpt: The current study aimed to assess interaction experiences between deaf citizens and law enforcement officers. It used a three-pronged method of data collection, with survey responses elicited from deaf citizens across the United States with an experience of interacting with law enforcement, interviews with deaf citizens in the District of Columbia, Maryland, and Virginia areas about their experiences with law enforcement, and one interview with a law enforcement officer about policies and procedures they have in place when interacting with a deaf citizen. The survey data was analyzed using both quantitative and qualitative approaches. Both sets of interviews were analyzed through a phenomenological framework to understand the meaning of the deaf citizen-law enforcement officer interactions described, the participants’ behaviors from both parties’ perspectives, and how both parties interpreted these types of experiences. Effective communication was a consistent theme throughout, where participants that were able to engage in effective communication with police reported a more positive experience compared to participants who did not engage in effective communication with the police. Additionally, perspectives held about the police were found to be similar to negatively held perspectives of police officers by citizens of color. Specific recommendations on approaches to improve deaf community-police interactions are also discussed. -- Abstract.
