Frequently left out of policy making and research, almost no resources exist that can inform and aid law enforcement, legal, and correctional officials on culturally competent interactions with the Deaf and hard-of-hearing. As a result, this group is at a distinct disadvantage when dealing with law enforcement or the courts as well as being vastly underserved, which often lead to negative outcomes for the Deaf suspect/defendant/inmate as they attempt to interact with law enforcement and navigate the legal system. In a step-by-step presentation from arrest to incarceration each chapter will discuss a specific part of the legal system. As well as providing information on the topic, this book can serve as an important resource to the myriad of issues and difficulties that may be experiences by the Deaf suspect, defendant, or inmate, as well as by law enforcement officers, attorneys, and correctional officers. To illustrate these issues, previous cases of Deaf suspects, defendants, and inmates will be presented and discussed to clarify key issues and to provide a perspective of the problem. Each chapter dealing with these issues will also provide suggestions for more culturally competent interactions between the Deaf community and the legal system.

Book excerpt: Research shows there is a separation between the hearing community and the Deaf community in terms of communication. While there is little research specific to interactions between law enforcement and the Deaf community, it is probable a communication barrier exists between law enforcement officers and the Deaf community as well, due to law enforcement officers not being properly trained to interact with this community of individuals. This study examines law enforcement officers’ perspectives of working with the Deaf community. Using qualitative data collected through interviews, law enforcement officers in central Texas provided insight based upon their experiences with members of the Deaf community. From these interviews it was found that law enforcement officers are not receiving efficient training to prepare them for interactions with individuals with communications barriers, like Deaf individuals. The findings of this exploratory qualitative study revealed support for continued research examining the experiences of law enforcement officers with the Deaf community as well as the possible need for further training for law enforcement in this area.

Book excerpt: The current study aimed to assess interaction experiences between deaf citizens and law enforcement officers. It used a three-pronged method of data collection, with survey responses elicited from deaf citizens across the United States with an experience of interacting with law enforcement, interviews with deaf citizens in the District of Columbia, Maryland, and Virginia areas about their experiences with law enforcement, and one interview with a law enforcement officer about policies and procedures they have in place when interacting with a deaf citizen. The survey data was analyzed using both quantitative and qualitative approaches. Both sets of interviews were analyzed through a phenomenological framework to understand the meaning of the deaf citizen-law enforcement officer interactions described, the participants’ behaviors from both parties’ perspectives, and how both parties interpreted these types of experiences. Effective communication was a consistent theme throughout, where participants that were able to engage in effective communication with police reported a more positive experience compared to participants who did not engage in effective communication with the police. Additionally, perspectives held about the police were found to be similar to negatively held perspectives of police officers by citizens of color. Specific recommendations on approaches to improve deaf community-police interactions are also discussed. -- Abstract.

Book excerpt: It is critically important to foster a resilient Deaf and hard-of-hearing (Deaf/HH) population empowered to act in a pre-event phase before and respond during and after critical large-scale public health emergencies. Standard all-hazards emergency preparedness risk & response communication efforts don't always reach people with barriers relating to literacy, language, culture or disability. This is a significant problem given that there is a growing body of evidence of higher risk during disasters for injury, death, property loss for 32 million Deaf/HH Americans and for 90 million Americans with low-literacy skills. It is beneficial to use a participatory, community-directed approach to improve all-hazards preparedness capacity for the Deaf/HH. This dissertation is in a three-paper format. Part I, a literature review, systematically examines all-hazards emergency communication access for the Deaf/HH during large-scale disasters with an eye towards maximizing emergency preparedness capacity within the Deaf community. The literature review does not simply examine lessons learned from any access issues that have been documented in previous disasters but also reviews the peer reviewed and gray literature (non-peer-reviewed literature, often non-published reports) to determine the need for interventions or systemic change on a policy-level. By identifying the scope and magnitude of the problem, this literature review is a stepping stone for Parts II and III, which aim to develop best practices for educational outreach and training for first responders. Part II is a program evaluation utilizing mixed methods of a training program for law enforcement officers at the scene of domestic violence (DV) emergencies involving the Deaf/HH. A program evaluation of cultural competency training for the Deaf/HH has never been published, to my knowledge, despite several available trainings for first responders or medical professionals and students nationally (Appendix 1). Once trainings are developed, standardized and shown to be beneficial, they can be distributed to Deaf/HH audiences and/or first responders, which can sustain longer-term development efforts that might mitigate the impact of future emergencies or improve the quality of life/infrastructure on broader levels. Part III is a qualitative exploration of barriers, attitudes, perceptions, and knowledge of law enforcement and first responders regarding working with the Deaf/HH in an emergency. Specific abstracts for each Part can be found in the corresponding section. The closing section provides a summary of policy and legislative developments on a national level that are informed by Deaf/HH experts in emergency communication; these developments have implications for further research and practice to address disparities in emergency preparedness communication for the Deaf/HH.
