Frank Upham shows conclusively that this view is mistaken and demonstrates that the law is extensively used, on the one hand, by aggrieved groups to articulate their troubles and mobilize political support and, on the other, by the government to channel and manage conflict after it has arisen. This is the first Western book to take law seriously as an integral part of the dynamics of Japanese business and society, and to show how an informal legal system can work in a complex industrial democracy. Upham does this by focusing on four recent controversies with broad social implications: first, how Japan dealt with the world's worst industrial pollution and eventually became a model for Western environmental reforms; second, how the police and courts have allowed one Japanese outcast group to use carefully orchestrated physical coercion to achieve wide-ranging affirmative action programs; third, how Japanese working women used the courts to force employers to eliminate many forms of discrimination and eventually convinced the government to pass an equal employment opportunity act; and, finally, how the Ministry of International Trade and Industry and various sectors of Japanese industry have used legal doctrine to cope with the dramatic changes in Japan's economy over the last twenty-five years. Book excerpt: The recent manifestation of exclusionism in Japan has emerged at a time of intensified neoliberal economic policies, increased cross-border migration brought on by globalization, the elevated threat of global terrorism, heightened tensions between East Asian states over historical and territorial conflicts, and a backlash by Japanese conservatives over perceived historical apologism. The social and political environment for minorities in Japan has shifted drastically since the 1990s, yet many studies of Japan still tend to view Japan through the dominant discourses of “ethnic homogeneity (tanitsu minzoku shakai)” and “middle-class society (so ̄churyu ̄-shakai)” which positions the exclusion of minorities as an exceptional phenomenon. While exclusionism has been recognized as a serious threat to minority groups, it has not often been considered a representative issue for the whole of Japanese society. This tendency will persist until the discourses of tanitsu minzoku shakai and so ̄churyu ̄-shakai are systematically debunked and Japan is widely recognized as both multiethnic and socio-economically stratified. Today, as with most advanced capitalist countries, serious social divides occasioned by the impacts of globalization and neoliberalism have destabilized Japanese society. This book explores not only how Japanese society is diversified and unequal, but also how diversity and inequality have caused people to divide into separate realities from which conflict and violence have emerged. It empirically examines the current situation while considering the historical development of exclusionism from the interdisciplinary viewpoints of history, policy studies, cultural studies, sociology and cultural anthropology. In addition to analyzing the realities of division and exclusionism, the authors propose theoretical alternatives to overcome such cultural and social divides.

In compelling, poignant, and sometimes horrifying court cases, West finds that Japanese judges frequently opine on whether a person is in love, what other emotions a person is feeling, and whether those emotions are appropriate for the situation. Sometimes judges’ views about love, sex, and marriage emerge from their presentation of the facts of cases. Among the recurring elements are abortions forced by men, compensated dating, late-life divorces, termination fees to end affairs, sexless couples, Valentine’s Day heartbreak, "soapland" bath-brothels, and home-wrecking hostesses. Sometimes the judges’ analysis, decisions, and commentary are as revealing as the facts. Sex in the cases is a choice among private "normal" sex, which is male-dominated, conservative, dispassionate, or nonexistent; commercial sex, which caters to every fetish but is said to lead to rape, murder, and general social depravity; and a hybrid of the two, which commodifies private sexual relationships. Marriage is contractual; judges express the ideal of love in marriage and proclaim its importance, but virtually no one in the court cases achieves it. Love usually appears as a tragic, overwhelming emotion associated with jealousy, suffering, heartache, and death.
