Le but de ce travail est, dans un premier temps, de présenter les particularités inhérentes aux auditions d'enfants victimes d'abus sexuels et les techniques d'entretien généralement recommandées par la communauté scientifique pour y procéder. Dans un deuxième temps, il s'agit de questionner la position de la Suisse, plus particulièrement des cantons de Vaud et Genève, sur cette délicate question. En guise de réflexion finale, il est présenté un exemple qualifié de " bonne pratique " par le Conseil de l'Europe notamment.

De plus, les abus sexuels ne laissent que peu de traces médicales et l'absence de marques extérieures sur le corps rendent leur décèlement d'autant plus compliqué (Bussey & Grimbeek, 1995 cités par Themeli & Panagiotaki, 2014). La parole de l'enfant est donc très importante dans ces situations, car elle constitue, en règle générale, l'un des seuls éléments à apporter devant le juge. Dès lors, l'audition d'un enfant abusé sexuellement prend toute son importance. A travers ce travail, nous souhaitons, dans un premier temps, mettre en avant les éléments importants, ainsi que les différentes formes possibles d'audition. Dans une seconde partie, nous mettrons en exergue ce qui est mis en place en Suisse Romande et notamment dans les cantons de Vaud, de Neuchâtel, de Genève et du Jura. Dans une troisième partie, qui clôturera notre réflexion, nous discuterons des éventuelles améliorations possibles pour les cantons observés, puis nous aborderons l'impact qu'une audition ne respectant pas les éléments présentés dans la première partie peut avoir sur les jeunes victimes d'abus sexuel.
