Book excerpt: La legge 6 novembre 2012 n. 190 ha messo mano al codice penale nella parte in cui prevede la punibilità dei reati dei pubblici ufficiali contro la pubblica amministrazione. La legge – che arriva a riformare il sistema dopo 22 anni dalla precedente legge di riforma del 1990 – è frutto di vivaci stimoli comunitari ed internazionali indirizzati all’Italia. Gli osservatori stranieri, infatti, hanno messo in evidenza l’insufficienza della legislazione italiana – non solo penale ma anche amministrativa – nella lotta alla corruzione, ritenuta vera e propria “piaga” e produttiva di ingenti costi economici, anche riguardo alla distorsione della concorrenza e delle dinamiche del mercato interno e comunitario. Il comma 75 dell’art. 1 contiene le modifiche al codice penale che vanno ad aggiungersi (e completare) il complesso quadro normativo previsto con riferimento all’organizzazione e all’attività della pubblica amministrazione. Adottando una prospettiva sinergica, il legislatore della riforma ha modificato altresì il reato societario della corruzione tra privati, che trova disciplina nel codice civile, ad indicare la necessità di una strategia di attacco “totale”.
