Download or read book Robert Latimer written by Gary Bauslaugh and published by Lorimer. This book was released on 2010-09-16 with total page 184 pages. Available in PDF, EPUB and Kindle. Book excerpt: In October 1993, Robert Latimer, a Saskatchewan farmer, decided to end the life of his chronically ill daughter rather than subject her to another painful surgery. Tracy, who had the mental capacity of a five-month-old infant, was twelve at the time of her death. She had already endured multiple operations to correct conditions caused by her severe cerebral palsy. Tracy's death and the charge of murder laid against Robert Latimer set in motion Canada's most famous and controversial case of "mercy killing." The case sparked a national debate about euthanasia and the rights of the severely disabled that continues today. Author Gary Bauslaugh takes us back to the beginning of this case, describes its explosion on the national scene during two highly publicized trials, and looks at later conflicts surrounding Latimer's parole hearing. In clear, insightful prose, Bauslaugh discusses the conflicting views of Latimer's sympathizers and detractors in chapters that explore the ethical dilemmas as well as the legal issues that this case has raised. As a reporter who has followed the case from its beginnings and interviewed Latimer multiple times during his imprisonment and subsequent parole, Bauslaugh's intimate knowledge of the personalities and facts of this difficult case allow him to write a revealing and informed book.

Download or read book Fugitive Justice written by Steven Lubet and published by Harvard University Press. This book was released on 2011-03-15 with total page 378 pages. Available in PDF, EPUB and Kindle. Book excerpt: During the tumultuous decade before the Civil War, no issue was more divisive than the pursuit and return of fugitive slaves—a practice enforced under the Fugitive Slave Act of 1850. When free Blacks and their abolitionist allies intervened, prosecutions and trials inevitably followed. These cases involved high legal, political, and—most of all—human drama, with runaways desperate for freedom, their defenders seeking recourse to a “higher law” and normally fair-minded judges (even some opposed to slavery) considering the disposition of human beings as property. Fugitive Justice tells the stories of three of the most dramatic fugitive slave trials of the 1850s, bringing to vivid life the determination of the fugitives, the radical tactics of their rescuers, the brutal doggedness of the slavehunters, and the tortuous response of the federal courts. These cases underscore the crucial role that runaway slaves played in building the tensions that led to the Civil War, and they show us how “civil disobedience” developed as a legal defense. As they unfold we can also see how such trials—whether of rescuers or of the slaves themselves—helped build the northern anti-slavery movement, even as they pushed southern firebrands closer to secession. How could something so evil be treated so routinely by just men? The answer says much about how deeply the institution of slavery had penetrated American life even in free states. Fugitive Justice powerfully illuminates this painful episode in American history, and its role in the nation’s inexorable march to war.

"These...volumes belong in every library used for research, and in particular at all law school libraries. They will prove valuable to historians, lawyers, law teachers and students, and all persons interested in the problems of slavery and race in American experience.": William M. Book Synopsis Abolitionism and American Law by : John R. McKivigan
Download or read book Abolitionism and American Law written by John R. McKivigan and published by Taylor & Francis. This book was released on 1999 with total page 424 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume's essays reveal that the abolitionists' impact on United States law and the Constitution did not end with the Civil War. The immediate postwar Reconstruction amendments were both rooted in the radically anti-positivistic, natural rights philosophy long espoused by the radical political abolitionists. Implementing protection for black civil rights, however, proved much more difficult.
