It examines the relationship between integration and the legal frameworks of admission, stay and access to nationality by third country nationals at national and European levels. Integration is being subject to multifaceted processes transforming its traditional policy and legal settings, as well as its classical theoretical premises and approaches. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy.

Internationally adopted kids are coming from many of the same countries as do the many immigrants who are radically transforming Spain's demographics. Based on interviews with adoptive families, migrant families, and adoption professionals, Jessaca B. Leinaweaver examines the experiences of Latin American children adopted into a rapidly multiculturalizing society. She focuses on Peruvian adoptees and immigrants in Madrid, but her conclusions apply more broadly, to any pairing of adoptees and migrants from the same country. Leinaweaver finds that international adoption, particularly in a context of high rates of transnational migration, is best understood as both a privileged and unusual form of migration, and a crucial and contested method of family formation. Adoptive Migration is a fascinating study of the implications for adopted children of growing up in a country that discriminates against their fellow immigrants.

In the last twenty-five years, Spain has gone from being a country of net emigration to one in which immigrants make up nearly 12 percent of the population. This rapid growth has made migrants increasingly visible in both mass media and in Spanish visual and literary culture. This book examines the origins of media discourses on immigration and takes the analysis of contemporary Spanish culture as its primary framework, while also drawing insights from sociology and history. Emigrant Dreams, Immigrant Borders introduces readers to a wide range of recent films, journals, novels, photography, paintings, and music to reconsider contemporary Spain through its varied encounters with migrants. It follows the stages of the migrant’s own journey, beginning outside Spanish territory, continuing across the border (either at the barbed-wire fences of Ceuta and Melilla or the waters of the Atlantic or the Strait of Gibraltar), and then considers what happens to migrants after they arrive and settle in Spain. Each chapter analyzes one of these stages in order to illustrate the complexity of contemporary Spanish identity. This examination of Spanish culture shows how Spain is evolving into a new space of imagination, one that can no longer be defined without the migrant—a space in which there is no unified identity but rather a new self-understanding is being born. Since the global hegemony of human rights as a language for human dignity is nowadays incontrovertible, the question of whether it can be used in a counter-hegemonic sense remains open. Inspired by struggles from all corners of the world that reveal the potential but, above all, the limitations of human rights, this book offers a highly conditional response. The prevailing notion of human rights today, as the hegemonic language of human dignity, can only be resignified on the basis of answers to simple questions: why does so much unjust human suffering exist that is not considered a violation of human rights? Do other languages of human dignity exist in the world? Are these other languages compatible with the language of human rights? Obviously, we can only find satisfactory answers to these questions if we are able to envisage a radical transformation of what is nowadays known as human rights. Herein lies the challenge posed by the Epistemologies of the South: reconciling human rights with the different languages and forms of knowledge born out of struggles for human dignity.

It seeks to challenge a predominant historiography focused on the study of borderlands societies, relying exclusively on the antagonistic topics of subversion and the construction of boundaries. It states that by focusing just on one concept or another there is a restrictive understanding tending to condition the agency of local communities by external narratives. Thus, if traditionally border people were reduced by some scholars to actors of a struggle against a supposedly imposed border; in a more modern perspective, their behaviors have been also framed in bottom-up processes of consolidation of spaces of sovereignty in a no less limiting vision. Faced with both approaches, the objective of this work is not to deny them but, first and foremost, to situate the experiences of border populations outside of logics that I understand as originally alien to themselves, and to highlight their own subjectivity. Finally, it also demonstrates that most of the practices developed by border people were fundamentally aimed at defending their local communities. It will be useful for both audiences interested in early modern Iberia or border studies from a bottom-up perspective.
