Available in PDF, EPUB and Kindle. Book excerpt: Challenging the ruling premises underlying many of the Supreme Court's positions on fundamental issues of government authority and individual rights, Tribe shows how the Court is increasingly coming to resemble a judicial Office of Management and Budget, straining constitutional discourse through a managerial sieve to defend its constitutional rulings. Tribe explains how the Court's "calculus" systematically excludes basic concerns about the distribution of wealth and power and conceals fundamental choices about the American polity. Calling for a more candid confrontation of those choices, Tribe exposes what has gone wrong and suggests how the Court can reclaim the historic role entrusted to it by the Constitution. Available in PDF, EPUB and Kindle. Book excerpt: This book provides the answers to controversial questions about religious liberties in the United States and connected issues through balanced, thorough, and nonjudgmental coverage of the issues in a reference format. The subject of religious freedom is important to all American citizens, regardless of religious affiliation or ethnicity. Are the rights of religious individuals being eroded, or is religion being unfairly used to deny basic secular rights to individuals? How will religious institutions adapt to changes in legislation that have an impact on how they operate? Does the Supreme Court have the right to enforce these changes? Finally, how can the precarious separation of church and state be maintained while simultaneously respecting both institutions? This single-volume work provides an introduction that addresses the historical background of religious freedom in America, accurately explains the latest legal developments in religious freedom in the United States, and presents an unbiased account of the probable impact of the new Freedom of Religion laws in the continuing culture war. Readers will gain insight into key controversies such as prayer in public schools, creationism versus evolution, abortion, religious objections to medical care, religious displays in public places, same-sex marriage and LGBT rights, and state and federal religious freedom acts. The book also includes perspective essays by outside contributors, a selection of useful primary documents, a listing of print and nonprint resources, a chronology, and a glossary of terms.

Available in PDF, EPUB and Kindle. Book excerpt: This book presents a provocative perspective on the impact of the Reagan administration. Many political commentators, both liberal and conservative, argue that the 1980s was a period of fundamental conservative change. Some of them believe the changes have been so important that the 1980s should be seen as a watershed period in American political history as significant as the 1930s. Schwab denies this thesis and points out that politics and policy did not fundamentally change in a conservative direction. Instead, he demonstrates how policy developments and the political system actually moved in the opposite direction. In the realm of public opinion, Schwab points out that sentiment tends to shift toward the left rather than the right. Support for social and environmental programs remained high and even increased during the Reagan era, whereas support for defense programs dropped to a near-record low. Instead of a New Right conservative shift in public opinion on social issues, Americans became more liberal on women's rights, minority rights, and sexual behavior issues. Schwab's critique extends as well to Reagan's political success and popularity. Rather than being one of the most successful presidents in leading Congress, he was one of the least successful. His conservative ideology lessened support for him among many voters and congressional liberals gained more voter support during the 1980s' elections than conservatives.

Available in PDF, EPUB and Kindle. Book excerpt: On February 28, 1993, the United States Bureau of Alcohol, Tobacco, and Firearms (BATF) launched the largest assault in its history against a small religious community in central Texas. One hundred agents armed with automatic and semi automatic weapons invaded the compound, purportedly to execute a single search and arrest warrant. The raid went badly; four agents were killed, and by the end of the day the settlement was surrounded by armored tanks and combat helicopters. After a fifty-one day standoff, the United States Justice Department approved a plan to use CS gas against those barricaded inside. Whether by accident or plan, tanks carrying the CS gas caused the compound to explode in fire, killing all seventy-four men, women, and children inside. Could the tragedy have been prevented? Was it necesary for the BATF agents to do what they did? What could have been done differently? Armageddon in Waco offers the most detailed, wide-ranging analysis of events surrounding Waco. Leading scholars in sociology, history, law, and religion explore all facets of the confrontation in an attempt to understand one of the most confusing government actions in American history. The book begins with the history of the Branch Davidians and the story of its leader, David Koresh. Chapters show how the Davidians came to trouble authorities, why the group was labeled a "cult," and how authorities used unsubstantiated allegations of child abuse to strengthen their case against the sect. The media's role is examined next in essays that considering the effect on coverage of lack of time and resources, the orchestration of public relations by government officials, the restricted access to the site or to countervailing evidence, and the ideologies of the journalists themselves. Several contributors then explore the relation of violence to religion, comparing Waco to Jonestown. Finally, the role played by "experts" and "consultants" in defining such conflicts is explored by two contributors who had active roles as scholarly experts during and after the siege The legal and consitutional implications of the government's actions are also analyzed in balanced, clearly written detail.
